Steps for K-1 Visa Application (London)

Hello everyone!

I am currently waiting on my NOA-2 and have been doing my best to research and plan ahead for future steps. In doing so I have come across some things I have questions on.

First I would like to state that I will be filing at the London embassy so if here has successfully gotten a K-1 Visa through this embassy (preferably recently!) your input would be invaluable!

My first question is in regards to the fee that will accompany the D-160 application. I found a list of prices on the embassy site here: http://london.usembassy.gov/niv/fee.html If I am understanding this right, then I only have to pay the $160 MRV fee, correct? I don't see the K-1 visa specifically mentioned anywhere for the list of fees, so I am slightly unsure.

My second question is about what to do with the forms needed for the interview. I am pretty sure I know what I all need but I came across this set of instructions specific to the London embassy: http://photos.state.gov/libraries/unitedkingdom/164203/cons-visa/iv_and_k_interview_checklist2014.pdf

My specific issue is with what is listed for filers after November 12th, 2014. It states:

"Applicants are required to submit copies of their documents to NVC and bring the original document to the visa interview. The original Affidavit of Support, Form I-864 is still required by NVC and will be forwarded to the Immigrant Visa Unit with your file and available to the consular officer at the interview."

I also noticed that they are calling for the I-864 Affidavit of Support and not the I-134 which is what I thought was needed in this process. These directions are throwing me off quite a bit, and if it wasn't for the fact that they were linked to the London Embassy website I would most likely disregard them, but I want to find out what is true and what isn't.

Thank you, any advice is sincerely appreciated!

HI there,

I'm at the final stage of the K-1 Visa Process in London, just waiting for my Interview date!

The fee the accompanies the D-160 is found here http://london.usembassy.gov/iv/visa_fees.html. While the K1 is technically a NIV, it is processed by the immigrant visa department at London. It is currently $265 :/

You should still be using the I-134 form as specified here http://london.usembassy.gov/iv/application_documents.html#012. You do not send this form to the NVC you bring it along with the supporting evidence to the interview. You must bring the original signed form however the supporting evidence may be photocopies.

The I-864 is used for the AOS process after you get married.

Best of luck to you!

Country-specific thread is moved from K-1 Process forum to the UK regional subforum, where a wealth of information on these very topics exists.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thank you for the information!

I guess I was just really thrown off by those instructions that mentioned sending stuff to the NVC as well as filling out the I-864.

I also don't know why I wasn't able to find the pages you did, must just been looking in the wrong spot!

I have one final question. At what point do I pay the $265, and is that the only charge for the application itself or do I have to pay the MRV as well?

They are all listed under the Immigrant Visa pages on the London Embassy website.

You pay the $265 when you get your "Packet 4" letter containing the interview date, it has information on where to go to pay the fee, you will probably also want to pay the courier fee to have your passport sent back to your house. Alternately you can pick it up from a local depot for free.

I guess I was just really thrown off by those instructions that mentioned sending stuff to the NVC as well as filling out the I-864.

The instructions you are looking at are for both spouse visas and fiance visas which have different processes.

This is your fiance paragraph. All your processing is done by the embassy---

Applications processed by the Embassy in London -

You are required to obtain the original documents or certified copies, and one photocopy (with the exception of your passport and photographs) of the following documents for yourself and each family member applying for a visa. All documents are required even if they were previously submitted to the United States Citizenship and Immigration Services with your petition.

This is written to spouse visa applicants because their processing is done at the NVC. You can mark out these two paragraphs---

Applications processed by the National Visa Center (NVC) -

If you submitted your original documents to the NVC prior to November 12, 2014, you will not be required to obtain additional copies. You should check the list below to ensure that you have obtained all applicable documents. If any applicable documents were not submitted to the NVC, you should be prepared to present them at the time of your interview.

From November 12, 2014: Applicants are required to submit copies of their documents to NVC and bring the original document to the visa interview. The original Affidavit of Support, Form I-864 is still required by NVC and will be forwarded to the Immigrant Visa Unit with your file and available to the consular officer at the interview.

The rest of the instructions are listing things brought to K1 interviews (or sent to NVC by spouse visa applicants which process there). Gather what is appropriate for you. For example, never in the military, then skip the military documents. When it gets to the end and Affidavit of Support, there are multiple instructions. Find the K1 bit.

The K1 instructions on the London embassy website are a good starting place. If you are using a phone or tablet, you will do a lot better on a computer. The mobile site is not as user friendly and you miss things.
