Yep,, it looks like you've summed up the situation entirely... She is in attorney land, but I have a feeling that attorney is going to say she's SOL. Not much an attorney can do if the alien is not in the US legally speaking and I doubt that there is going to be warm fuzzies in the USCIS's heart to go out of their way to 'help' this person...

Best of luck...

Ayup, it makes me wonder what happens if you get bounced at a deferred inspection.. an escort to the ticket counter? Do they give you any time before you have to leave? Might they admit her afterall? Most interesting, although I am sorry that my education would come at her expense.

I'd go to CR in her stead if I could.. can you tell I want to get out of town these days?!

Yeah.. if she does not pass deferred inspection, she's put on the next plane back... if the next plane back is not until the next day, they'll put her in detention for the night... if she does not go to deferred inspection, then as of the deadline she is an illegal alien and has no possibility of adjusting because she entered without inspection. No different if a person used a coyote to go across the desert...

I've often wondered... who pays for that flight back? Is it something the airlines just do?

The alien pays for the flight... and if the plane is full someone will get bumped and not the person getting removed. The government has first priority, part of the cost of getting the air route.

I guess I'll keep wondering what happens if they don't have a credit card or any other financial ability to pay for the ticket.
