Did you send in copies of your dad w-2,s?

If your dad file his taxes married jointly the w2,s are require with transcripts or copies of tax form

While current income is most important. I do not think you will have enough prove for your incone Since your case is already at the NVC. You probably should still use your dad as joint sponsor

the following is the checklist i got back.but i think i realized what i did.in part 3 section 5 (family section 5) i filled in my info thinking it was a different part of the form.my dad is currently a joint sponsor and i got a checklist for him to fill out i864a and i will have him do that if needed as i just got a new job that meets the requirements needed financially.but may have him do it anyways since i will start my new job in a week.i put "1" in section 7 in part 3. part 5 i added 1 for who im sponsoring and 1 for myself and got 2.i thought that is correct.i can take screen shots if needed.oh i just moved.actually going to move into my new apartment today..would i be able to just do a change of address on the form i need to fill out now or just email them like i have read elsewhere and leave my address the same?if not sure thats fine ill email and have it done that way so i have a record of the request.

On your I-864 form. The answer for intending immigrant will be one.

House hold size is the number of people you are finical responsible for not the number of people you are living with. You do not count anyone twice

On your form you will put one for yourself and one for your spouse and the total will be two

If your dad is a joint sponsor he will fill out a I-864 same as you. I do not know why you got a checklist for the I-864a that form is use if another person in your household size is using their income to help meet the income requirement

again household size is the number of people you are finical responsible for not the number of people living in household

On your Dad I-864 he will the answer for intending immigrant will be one

on the household size he will include himself your spouse your mom and or any other people he is responsible for

He will not include you

The above, is correct but, just to be clear, as to the "count" your spouse will still be counted as the intending immigrant.

Additionally, if your father is married and files joint tax return with his spouse, his spouse will need to provide an I-864a, whether she has any income or not. This significantly complicates what you have to learn, and how much attention you must pay to who signs where on the I-864a, as they both do.

If I were in your shoes, even though it may cost you a month or so, I think I would wait until I had a pay stub of my own to send in and just respond with a new I-864 for yourself, showing qualifying income. Have your spouse take an even more current pay stub to the interview as well. This avoids your parents obligating themselves potentially for life.

You see, the worst case scenario example (This is the "nice" one but there are less complimentary ones with the same result.) is that soon after your spouse arrives, the two of you are in a car accident that is your fault. You are killed and he is permanently disabled, become "public charge" or the responsibility, for life for your parents to take care of. If he never becomes a US Citizen, they are obligated until they die, or your spouse does.

For house hold size the intending immigrant will only be counted once. The newer form is a little different . So for the (0p) I-864 form part 5 question 1 the box will be 1. For part 5 question 2 the box will be 1. For part 5 questions 3 will be 0 since the intending immigrant can not be counted twice.part 5 question 4 and 5 will be 0 unless the person has dependents. PART 5 question 6 will be 0

unless another immigrant was sponsor before and is now LPR

PART 5 question 7 optional will be O unless you are combining your income which is not the same as a joint sponsor.

Question 8 add total which should be two unless any question 3 to 7 applies

If your Dad is a joint sponsor then he will also fill a I-864 form also . If he file married jointly with your mom and they are using their income then your mom will fill out part 1 1o 4 and part 6 of the I864a form. Your Dad will fill out part 5

If your Dad is only using his income then a I864a form will not be needed but the I-864 forms tax returns transcripts his w-2 to determine his gross individual income on tax returns. Also you can send copies of his paycheck stubs or employment letter

Correct except the part about "only using HIS income". If married and filing jointly, the spouse provides the I-864a, whether they even HAVE any income or not. Theoretically, this should not be necessary if the one spouse has enough personal income to qualify, but that theory does not work in actual practice.
