RESIDENCY REQUIREMENT IN USA

Hello All,

We got US immigration Visa last month under EB3. We live in Canada for almost 20 years and we are Canadians. I was main applicant and my spouse and son were accompanying applicant. Even Though I was main applicant, I got visa earlier as my wife birth country`s had less waiting time. It is called cross chargeability.

Now we have visa validity up to Feb 2016. We live in border town in Canada and I have about 40 minutes drive each way to work in USA everyday. Presently we live in Canada.

I have house in Canada and also my son is finishing his high school in June 2016. Also my wife works in Canada.Due to some commitments, we are thinking to move in USA before Feb 2016 so we will use our VISA for USA. I am thinking to rent Apartment in USA and we all move there. After a week or so staying in USA, my wife and son will move back in Canada and they will stay until June 2016. Then they will move to states permanently.

In a mean while we might cross border once a month or so. Is it a fair plan? I need guys your experience and advise.

Sounds reasonable, lot of people (Including myself) travel back and forth frequently to take care of things like school and work before moving to US permanently. As long as you dont spend most of your time in a year outside US you should be fine. Don't stay in canada for more than 180 days after you have used your visa to move to the US. Once you get apartment in the US, register your car and get licnse there as well to estabish residency as it will be easier to travel back and forth.
