K1 Visa - Philippine cenomar and divorce Decree

Everything in phils are slow, am not gonna let her file for rtc, your correct shes divorce and does that matter, so all she has to do is get her cenomar in nso, thats it? And she will need it when the time of her interview, no need for annoated one? Am i correct? Should I let her get cenomar now? Does it take so long. Get it?

Correct, your fiancee requests a CENOMAR from PSA (no longer NSO), PSA will issue a CEMAR showing she is married. She must have her divorce decree (and a copy for the embassy to keep).

Some can get the CENOMAR in a day, others take a couple days, depends on the PSA office.

Fee or no fee most lawyers don't have a clue on the visa process... tend to screw up more than help according to the history of posts I have seen on here. ;) Scary considering ...

hello. i am divorced in philippines by sharia court of law. now i am applying for marriage visa to germany. the german embassy asked me to submit my CEMAR with a remarks DIVORCED on it. but the PSA said they cant give remarks on my cemar since their computer systmem does not have the capabilities to register divorces. i have my annotated Marriage cert. have anyone here have knoweledge about my case. thanks for your answers.

hello my fiance is a dual citizen (us and fil),he filed the divorce when he was already a USC. are we qualified for judicial recognition?

Being he was a USC when filing the divorce I would say YES. There is only one other I remember from over the years that was the same situation and the divorce was recognized in the Phils.

Visa chase and citizenship.. DONE!

Hi Allyna. I believed you successfully got your k1 visa and youre in the states now? 

I have the same situation like yours. I got married here in Korea to my American husband and i reported it to the Phil embassy so basically we have report of marriage contracted abroad in the PSA/NSO. to make the story short he abandoned me and went back to the states been contacting him to file our divorce in California but he never did nor i get a response from him. He’s living now with another woman in California. Now i am planning to file our divorce here in Korea on the ground of abandonment. I met a decent man who’s serving in the US army and was here in Korea too. He went back to the states and wanted to petition me.

1. If i can get a divorce decree here in korea will it be ok if i will apply for K1 visa? And though i can only present the CEMAR not the CENOMAR? 

2. I am using the family name of my husband in almost all my documents.. passport, and the latest NBI that i requested two years ago.. will that matter if i will apply for my K1? Or should i change my family name to my maiden name (not sure if its possible since i am still married to him in the Phil) even of i get divorce here.

Hope to get some advice from you and from the people here.

She hasn't been back in over 2 years, not sure you will get a reply.

 

As for you filing for a divorce then once it is final moving forward with the K-1 Visa, there is not a problem having a CEMAR  w/divorce decree.

 

Current name used; you can't change your surname/family name until you have your divorce decree then  file for recognition of divorce with the RTC in the Philippines.    (recent Supreme Court decision ruled even if the Filipino files for the divorce this is acceptable)    It is not necessary to do this for the K-1 visa process.

Hi Hank thank you for the info. 

I actually called the Phil Embassy today and yes they told me that i cannot change the family name on my passport not until my marriage record in the PSA is anotated. 

Will it be ok to apply for K1 even if im still using my ex husbands family name on my passport?

My NBI also shows that i am married will it be an issue? 

Any info will be greatly appreciated.

Absolutely no issue applying for the K-1 using your existing surname (of EX husband), after all .. that is your legal name.

 

No issue with the NBI either.  Do make sure when your request a new NBI (for the visa application at the embassy) that you do an AKA for all names used  (maiden name and your married name  .. embassy requires this)

 

You will be process through the U.S. embassy in Korea?   (eventually)

Yes we are planning to process at USEM (Seoul, Korea).

Hopefully everything will goes smoothly.

 

Btw i Was also told of an officer from the Phil Embassy today that if i will choose to apply for recognition of divorce in the Phil it will most likely not granted. Because its me who initiate the divorce and not the foreign spouse. I told the officer that ok So Our Law protects the sanctity of Marriage and not its People. Its not ok to file for divorce though your spouse abandoned you for years and years and living with another woman. And all she can say was Sorry. (Sad reality)

The officer at the Philippines consulate is ILL informed (and WRONG) ... she should be staying in touch with current events in the Philippines.   The Supreme Court ruled that even IF you (Filipino) initiate the divorce that it must be accepted the same as if the foreigner initiated the divorce.   It made the news numerous times.
