Just like what theyve said..ur good to go for k1.. All u need to to do for ur divorce decree in the phil is just go to nso and ask ur Mc be annotated.. Foreign divorce is recognized in the phil and thats all u need to do.. As for cenomar, since urjust divorced but that doesnt make ur status single, nso will issue a cemar instead wen u request for cenomar. But thats fine, as long as u have ur final divorce decree..

I was divorce by Agreement. means Both my husband and i agreed to get divorce.

Some of my friends are divorce too and filed a divorce recognition in the Philippines and it cost them 150.000 pesos for the Atty. to process the divorce to the Phil Regional Trial Court.They said once its approve by the court you can take it to NSO and get you clear your divorce and get single status. the sad thing is its been one year and they are still waiting for the trial court to call them for personal appearance interview.

ive been searching and looking for some blogs and people with experience filing the divorce recognition in the phil and so far all i see and read is that there been waiting forever like one to two years. thank you for reply:)

do you think it will be recognize faster if my ex husband is going to the phil and file for my divorce recognition? i cant wait for a years like that cause my korean visa will expired in one year.I dont want to process papers in Phil cause the system are so slow :( But im really happy for your reply about Im good to go and not worry about my issue in my divorce in Phil. Your EX husband is Korean, a foreigner, he can do nothing regarding the process in the Philippines.

You do NOT need the recognition of divorce to complete the visa process, you do need to be free to marry at the time of filing the I-129F petition - your divorce decree shows that you are. :thumbs:;)

Your EX husband is Korean, a foreigner, he can do nothing regarding the process in the Philippines.

You do NOT need the recognition of divorce to complete the visa process, you do need to be free to marry at the time of filing the I-129F petition - your divorce decree shows that you are. :thumbs:;)

Are you a lawyer or working in US immigration?or in public service in US? or your also done the same process and your sharing all experience issues to help people around here. dont be offended please:) it was great to know that you guys are here to help answering difficult questions like this.

Hello all speaking of recognition of divorce, my fiancee live in Phil's but divorce,to her foreign ex, does she still nees to file for that? Or we can file for k1 without it anymore as long as she have the divorce paper? Please help us! Ty!

She just needs to make her Mc annotation from NSO, ask her to brimg her final divorce decree. She does not need to do any recognition processing coz foreigm divorce from a foreign national spouse is recognized in the philippines.. Then ur good to go for k1

You do not need the divorce decree recognized in the Philippines for the visa process, your fiancee will need to bring her divorce decree (and a copy for the embassy to keep) to the interview.

Follow the embassy instructions letter for what is required.

If the divorce was initiated by the foreign spouse your fiance can get her divorce recognized in the Philippines.

I suggest if you decide to get the divorce recognized in the Phils that your fiancee contact an attorney, the process is not as simple as showing up at PSA (use to be NSO)

Here is the process your fiancee must follow: (do remember this is not required for the visa process)

Annotation on the effects of divorce declared in a foreign country

A request for copy issuance of COM with annotation on the effects of divorce abroad resulted to a negative result or COM without annotation.

How to correct

  • The divorce decree granted by a foreign country must first be filed for recognition in the Philippine Regional Trial Court (RTC).
  • Once the local court recognized the foreign divorce decree, register it to the LCRO of the place of jurisdiction of the RTC which granted the petition.
  • The next step is to provide the copy of the registered court decree and certificate of finality to the LCRO where the marriage was registered for the annotation in the COM.
  • Once registered, you may now request for an annotated COM at NSO. The complete set of documents: registered court decree, certificate of finality, certificate of registration and the annotated COM is to be forwarded through courier to NSO for processing. Also hand-carry the set of documents for filing an application at NSO-Central Outlet, East Avenue.

That is not correct. Embassy do NOT require the MC be annotated, the embassy will accept the divorce decree without issue.

The marriage certoficate needs anotation from nso coz during her interview she will be asked to present that

Wrong. The embassy will accept the divorce decree without the MC at PSA being updated.

Having the divorce recognized in the Philippines is SOLELY for the Philippines, is not needed nor required by the embassy.

The embassy will accept the divorce decree without the MC at PSA being updated. Having the divorce recognized in the Philippines is SOLELY for the Philippines, is not needed nor required by the embassy.

Everything in phils are slow, am not gonna let her file for rtc, your correct shes divorce and does that matter, so all she has to do is get her cenomar in nso, thats it? And she will need it when the time of her interview, no need for annoated one? Am i correct? Should I let her get cenomar now? Does it take so long. Get it?
