CENOMAR is standard requirment for k1 visa, but the usem will only require u wen u already have ur packet3.. Since ur fiamce is divorced with a foreign husband, she will still need to apply for cenomar but she will be givem a cemar instead, but she will only need to attach her final divorce decree to the cemar just to establish that she is already free to marry.. It will be ok..usem will tramp the cemar because of her divorce decree

Hi Eliyan, I think we have the same situation like yours, am filing for k1 visa my fiancee is from Philippines and she got divorce from her foreign ex husband, she got the original copy of decree of divorce with notary one, we hired an immigration lawyer, now my fiancee was thinking about cenomar things in Philippines,which she said her status indicated married but the , lawyer said cenomar isn't really a requirements for k1 visa. Now am confused, is she just going to bring her decree of divorce ? And attach the cenomar or cemar when the time of her interview?

How can I say this? ... you got one ignorant attorney.

Thanks hank I appreciate it, so you meant to say she's just going to show her decree of divorce to co to view it and won't need it yet the cemar? I just opened the link that u sent, yes sure it does one of req. If its a requirements to get that CFO sticker , arent they questioning her about the cemar coz her status there married and it does show her ex name on it? Can she just show her divorce and attach the cemar?

Your lawyer is wrong. Cenomar is one of the requirement of usem whether she's single or not. If her cenomar says that she is married then she just need to attach her foreign divorce decree with an english translation. Been there done that! Dont listen to your lawyer....

CENOMAR is required by the embassy, in your fiancee's case it will be a CEMAR showing she is still married. For the embassy you will show the divorce decree and provide them a copy to keep.

As for CFO, they also require a copy of the CENOMAR, and yes they will need to see the divorce decree also. CFO is a critter of its own, never sure how they react to things. One thing I suggest to those completing CFO is to be self-assure and confident during the interview, looking the counselor in the eyes when speaking (but this holds true for the interview at the embassy as well ;) )

Hi to everyone here ,please help me.

i was married to a korean guy in Philippines and got divorce in Korea. I got my divorce decree authenticated and sealed by the Phil Embassy in Korea. I dont want to file for divorce recognition in the Philippines because it cost lots of money and it takes forever like one to two years and no further assurance when it will be recognize or get done. So my record in NSO will still remain Married. I live in korea now. My boyfriend is a US army and currently in US now wanted to file for K1 visa. We are worried that there will be a conflict on my papers for this situation.I read here that the US embassy accept divorce decree and Cenomar with my ex husband name on it for K1 visa. But im still worried that after passing K1 visa and when i get to U.S is the issue that i am still married in phil is close? like there can still be a possible conflict in the marriage process in the U.S? how about immigration? and applying or processing for residence I.D? or green card. no prosecutionproblem issues in US law,?the fact that i am still married in phil and another marriage in US that i might be deported and cancelled visa ?,? all this issues and question is stressing me a lot and feeling frustrated here! please anyone who have done their K1 and already done the process of marriage and living in US with same issues with me I will really be greatful to hear some response , plus do i need a cfo cert if im flying to us from korea? thanks.

Recognition of a foreign divorce has been recently simplified in Phils. If you want to clear that up, its easier and cheaper to do now. Although you do not need to clear that up in order to get your K-1 visa. As far as the rest of the world it concerned, you're divorced, on the Philippines considers you married until you get your divorce recognized in Phils. So there is no issue with your previous marriage when you reach the USA.

You also won't need to attend the CFO if you're flying from Korea to the USA after getting your visa. If you make a stop in Phils first, you may need to get a CFO sticker.

As Cary said you are - good to go! :thumbs:

You only need the CENOMAR and NBI (for travel abroard) for the interview at the embassy in Korea, after that no one asks for it.

As you know until you complete the recognition of divorce in the Phils you are still married to your EX there, to the rest of the your divorce decree is valid.

Just like what theyve said..ur good to go for k1.. All u need to to do for ur divorce decree in the phil is just go to nso and ask ur Mc be annotated.. Foreign divorce is recognized in the phil and thats all u need to do.. As for cenomar, since urjust divorced but that doesnt make ur status single, nso will issue a cemar instead wen u request for cenomar. But thats fine, as long as u have ur final divorce decree..

Yah, im aware of that hehe i guess it was her x husband who initiated the divorce proceedings.. And im also aware that the recognition of foreign divorce in the phil are only for those whose spouses are foreign nationals. Unlike mine. Coz my x husband is also a filipino who is in the pI. I just filed divorce here in HK

Correct. Your divorce will not be recognized in the Philippines.

Foreign divorces are only recognized in the Philippines if the foreign spouse initiated the divorce proceeding

I was divorce by Agreement. means Both my husband and i agreed to get divorce.

Some of my friends are divorce too and filed a divorce recognition in the Philippines and it cost them 150.000 pesos for the Atty. to process the divorce to the Phil Regional Trial Court.They said once its approve by the court you can take it to NSO and get you clear your divorce and get single status. the sad thing is its been one year and they are still waiting for the trial court to call them for personal appearance interview.

ive been searching and looking for some blogs and people with experience filing the divorce recognition and so far all i see and read is that there been waiting forever like one to two years.

Every country has their ways, and the Philippines recognizes that as acceptable... good to know.

Waiting seems to be a way of life within the system in the Philippines... :unsure:

do you think it will be recognize faster if my ex husband is going to the phil and file for my divorce recognition? i cant wait for a years like that cause my korean visa will expired in one year.I dont want to process papers in Phil cause the system are so slow :( But im really happy for your reply about Im good to go and not worry about my issue in my divorce in Phil. Thank you so much.
