I was an F1 student. I fell in love, I was stupid, I dropped school and moved to a new city with him, we got married. After a year, we grew apart, he has been investing all the money to his business so we had never try to apply AOS. Now, everything between us has broken. He doesnt love me anymore, I dont know what to do right now. If i leave, i might be facing penalty since i quit school and still staying here. But i cant do anything here. So i guess i will be facing a 3 or 5 year ban without doing anything wrong but trusting a man i thought he was the one.

I don't see why there should be any ban. However, it may still be hard for you to come back to visit given this history.

But I am pretty sure right now, what they see its i dropped school and overstay here for almost 10 months. When i dropped school, my F1 was changed to out of status.

So will it trigger a ban to reenter the country. I still plan to come back for my friends and possibly work.

You need 180 days of "unlawful presence" and then leaving the US to trigger a 3-year unlawful presence ban. You need 1 year of "unlawful presence" and then leaving the US to trigger a 10-year unlawful presence ban.

As far as I can tell you have not accumulated any "unlawful presence". Simply being out of status does not trigger unlawful presence. Only the following 3 things can trigger "unlawful presence" to start accumulating:

  1. you exceed the date on your I-94 (this is impossible for people who get "D/S" on their I-94s, like almost all F-1 students)
  2. an immigration judge makes a final order against you
  3. you apply to USCIS for some benefit and it is denied for you being out of status

I agree, if you leave now before anything worse happens you will not have a ban.

You don't actually say what you plan to do - are you looking for a way to stay legally in the USA and live (and perhaps go back to school) or are you planning to return to your homeland?

Are you divorced? In the process of getting divorced?

You were smart enough to get into school - try to return. If you can hire a lawyer, do so. Have a school ready to accept you. We value higher education in America and the foreign students in our universities. I think it can be done. Best bet: Have a school willing to vouch for you. Good luck.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
