Can't change to married name on SS?

You need to request a lost card. This will get you a card and the number.

Secondly, I'm surprised you were allowed a card under the circumstances. This should not be allowed until marriage in your case.

But either way congratulations on getting her to the USA!

Why? If I remember correctly even the checklist her on VJ says first thing you do when you come here you get a SSN card in your maiden name and after marriage you go get a new one in your married name and you only need your marriage certificate and a good amount of time left on your I-94.

I didn't try it that way because I got my SSN card 4 years ago when I was here on J1 but I've seen plenty of people on here do it with no issue whatsoever.

Hey, there will be the following problem why the mail office screwed it up. Do you live in the apartment building?

If yes, did you add your fiancee into the apartment lease? Post offices usually have the list of apartment dwellers and don't deliver mail to whom who is not in the list and owing the fact that the issued SSN was on the maiden name the mailman could just send it back to the place where it was issued.

According to the info you gave she did not have a green card at the time. Therefore she was not authorized to work. Therefore she is not allowed an SSC. She came over on a fiancé visa which is a nonimmigrant visa. This also does not allow someone to legally work in USA.

You need the green card first. Then Apply for SSN. At least this is what the SSA requires.

No need for Green Card. They will just issue a SSN that says "Valid for work only with DHS authorization".

Why can't she change it directly after marriage? Everyone else here has done it. Yes, some people meet someone completely incompetent who refuses but most of us have done it without issues.

I'm sure they do but not everyone needs a Green Card to be able to work. For example I got an SSN card that said that during my time as an Au Pair when I was working and I was only here on a J1.

So per the guides if you get a SS card, married/name change, second card w/ name change....do you have to get 3rd time after AOS/EAD?

Haven't quite gotten there in the process yet but I would assume so. But getting a SSN in your married name is easier for when you want to be added to bank account etc and you want to use your married name.

I mean she cannot change it on her SS card. She needs first the permission from USCIS. It can be approved EAD card or ss officer can mail directly to uscis, enclose her marriage certificate and wait for uscis decision.

No, that's some kind of myth that has been popping up these last few weeks.

Only thing she needs to do is go to the SSA office with her marriage certificate and passport and she's done. She doesn't need any permission from USCIS.

Maybe it's a new policy, in that case never mind. But I changed my name in August without no issues and I did not need permission from anyone.

Edit to add: Only time I'd see you having issues is if you're trying to change your name AFTER sending in AOS.

Did you have SSN from before you met your husband? Your case might be little different, because I read here and I met several people who couldn't change their name before EAD. I went to ssa office and was told that they can not verify my legal status (mu i94 was expired), and thus can not issue new ssc before I have my gc or EAD. Even after EAD it took them weeks before they sent new card. I called several times and they told me they are waiting for verification.

Maybe my ssa, and many others were incompetent and didn't know rules, but I'm just talking from my experience.

I've had an SSA card for 4 year BUT I have seen plenty of people here on VJ having no issues at all as long as they did it before they only had 2 weeks left on their I-94.

then you got lucky, I applied in Missouri in July and ss officer first asked me about approved EAD but eventually she agreed to send my marriage certificate to our local office. But it doesn't wok like this in most of the places. My friend in Idaho and in Alabama had to wait for their EAD first and then apply for the name change

That's weird. I just saw a whole bunch of people on VJ having no issues with it at all and went to the SSA office and found it super easy. Wouldn't have bothered going if I didn't see other people have success with it.
