Hi everyone,

I am a newbie here and I wish I found VJ sooner. This site is very helpfull and informative.

Right now I have my case delayed. The interview on 2/27/2007 at HCMC for my fiancee did not have a good outcome.The green slip stated that I need more proof of income and was asked for a 1722 letter.

My question is: Can a K1 Visa have a Joint sponsor for I-134 affidavit of support? I got confused when reading this forum. Some got approved with joint sponsors and some opinions stated otherwise.

Can someone confirm this. And what about asset, like a house, to contribute to the financial support?

I love my girl so much and we both are so sad.

I-129F sent and recieved by USCIS on Feb 16th, 2007-Also I fly to Vietnam to see my fiancee on today. This is the 4th times I have flied to vietnam within a year time frame. I miss her.

You will be the primary sponsor, and you will need to have a co-sponsor. Im not sure if they fill out a seperate form or not though. You need to make sure your co-sponsor is willing to commit to this though. The affidavit is valid for 5 years or until the benificiary becomes a USC.

There is no Joint Sponsors when it comes to the I-134, only a sponsor. It is not like the I-864 where there is provision for using a Joint Sponsor. If using someone else other than the petitioner, it should be someone that is a close family member or friend. If you call the Consulate/Embassy, quite often they will say that they do not accept a joint sponsor. This is true of all Consulates/Embassies, as I said, there is no provision for a Joint Sponsor when it comes to the I-134. If you do not meet the requirements, then you need to find another sponsor that does meet the requirements.

9 FAM 40.41 N4.6-3 Use of Form I-134, Affidavit of Support Under INA 213A

C) The simple submission of Form I-134, Affidavit of Support, however, is

not sufficient to establish that the beneficiary is not likely to become a

public charge. Although the income requirements of Form I-864, Affidavit

of Support Under Section 213A of the Act, do not apply in such cases

(i.e., the 125 percent minimum income, the need for three years income

tax returns), you must make a thorough evaluation of other factors, such

as:

(1) The sponsor's motives in submitting the affidavit;

(2) The sponsor's relationship to the applicant, (e.g., relative by blood

or marriage, former employer or employee, schoolmates, or

business associates);

(3) The length of time the sponsor and applicant have known each

other;

(4) The sponsor's financial resources; and

(5) Other responsibilities of the sponsor.

NOTE: When there are compelling or forceful ties between the applicant

and the sponsor, such as a close family relationship or friendship of long

standing, you may favorably consider the affidavit. On the other hand, an

affidavit submitted by a casual friend or distant relative who has little or no

personal knowledge of the applicant has more limited value.
