help advice on becoming a student

im looking for some help......me and my fiancee have been looking into the k1 now for a while, and have just realised that by the time we get to the 125% of poverty requirement on the I-134 we wont meet it

we must be together, so as an alternative im now looking into becoming a student, getting a student visa then eventually applying for a k3

has anyone had similar experiences? or know of any other useful sites, or how best to get into universities. im from the united kingdom and already educated to degree level. i have a Bsc Degree

really looking for a way around the 125% poverty guidelines sponsor issue

any help and advice much appreciated

I came in as a student to a community college, if you google for colleges in your fiance's area you'll be able to find a few. Then you can request forms to fill out for international students. I'm not sure of the exatc procedure for a uk citizen. But the school will want you to prove that you're not a financial liability - meaning when I did it I had to prove I had 20 000 just sitting in a bank (which I did only because his gparents gave us their banking account statements). You might want to try getting a work visa especially since you already have a degree.

If you can't exceed the poverty guidelines then how on earth are you going to be able to afford student costs?

when i entered on f-1 status I was not allowed to work until the completion of one year of schooling. So for one year you would not be able to work if you're entering f-1 status. It may be different for other categories.

I don't know which state you're coming from, but here is more info from the uni of MN. http://www.isss.umn.edu/fstudent/fwork.html. You can work if you can prove financial hardship, and the only other 2 categories apply if you've completed a full year of academics.

I wanted to also add that some people may feel you're trying to get around the immigration process. So if you do enter in student status and the person at your POE discovers you have a US fiance they will probably deny you entry. And you know your fiancee can also have a co-sponsor like her parents to help her qualify.

Mark,

Money is required for immigration because money is required to live. Why are you looking for ways to "get around" the issue rather than for ways to address the issue?

The approach you want to use is prone to risk in many areas if you make a habit of it.

i would be trying to get around the immigration progress but only because we wont have the money or another sponsor. just because we dont, doesnt mean we want to be together any less so im looking for ways around it so we can be

Hi Mark

Yodrak is right....is it possible that you don't have anyone who can be a co sponsor for the I-134? I tell you this because my husband (US Citizen) is not rich at all and he doesn't meet the requirements, but we found a co sponsor (his uncle) for the I-134. Try to take a look around and find a person who can help you.... going around things isn't always the best way.

In order to get a student visa one has to show considerable assets and an ability to pay for the entirety of the course, as I recall. That's a higher burden than making 125% of the poverty level - $16,500pa assuming that it will be only yourself and your wife-to-be.

How far short of the poverty level does your fiancees income fall? Is it something she could make up with a second job? Is it something which you have assets to cover?

125 percent of 2006 poverty guideline (family of four) $25,000

Sponsor's income $19,500

Difference $5,500

Multiply by 5

Minimum Required Cash Value of Assets $27,500

A student visa is not a cheap way round your problem, Mark, and with the second point above you will have to prove that you do not have immigrant intent - which, of course, you do. You may struggle to get an F1 for those two reasons alone.
