I've been in contact with my congressman's case manager. Uscis told her that my husband's i485 is in our local field office (Houston) with an officer. They won't give any more info like when we can expect to hear anything or receive an interview letter, but at least it's something.

Update

I had interview on 06/01 which did not go well.

She asked all the standard question from I-485 form. and asked when did I leave US last time, when did I arrived last time, under which status. asked to see my H1-B approval notice.

Then, She accused me of being out-of-status(in other words illegal presence in US) for a time between start of my H1-B status and end of my OPT. When argued, she boasted of having more knowledge of laws.(which obviously was wrong because she clearly didn't know about automatic extension of F-1 status when one is approved for H1-B). Then she didn't ask any question about our marrige, she didn't ask for any documents, any pictures. She just asked us to leave. Didn't ask anything to my wife who is petitioning for me. She handed us standard "120 days" waiting letter.

but to my surprise, our case was approved on 06/03. However, since then case status has not changed to "Card in Production". So I don't know how long it will take before my card arrives. I have heard people's status change within a day from "case approved" to "card in production".

Please advice on what should I do?

P.S. I was F-1 student as well and my AOS interview was at Newark, NJ

Update

Wow, I'm schedules at Newark, NJ as well... and also am on H1B... and when my OPT ended in 2010 my work permit extended since H1B application was pending through Cap-Gap rule.. Hah hope I won't be appointed to the same officer :D

If yours says approved then I think you should be getting your card soon...

Wow, I'm schedules at Newark, NJ as well... and also am on H1B... and when my OPT ended in 2010 my work permit extended since H1B application was pending through Cap-Gap rule.. Hah hope I won't be appointed to the same officer :D

If yours says approved then I think you should be getting your card soon...

If you do get her, I would highly recommend you to get the print-out of this page from USCIS website and highlight the following sentences under sub-title

"Eligibility for an Extension"

"Once a timely filing requesting a change of status to H-1B on October 1 has been made, the automatic Cap-Gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student’s H-1B petition is selected and approved, the student’s extension of status will continue through September 30"

I think some officers are clearly unaware of this rule and when you try to explain them, they don't seem to like it. If I had this page with me, I would have just shown her the printout.

Btw, I just received the I-485 approval notice in my mail, which proves I was absolutely correct but she didn't let me explain her the rules, instead she cut me out in between and boasted of her knowledge of laws.

Me too. My field office is a bit backed up compared to others. I talked with my congressman's liaison last week though. She said USCIS said my file is in my local field office with an officer but couldn't provide any more detail than that.

I regularly check this page https://egov.uscis.gov/cris/processTimesDisplayInit.do last update for Seattle was 31st of March and they were working on 29th of Sept *Sigh*

Update on hubs green card:

On 6/9 - I contacted my congressional liaison to file an inquiry. She responded that his aos was with my local office but no eta for when it might be processed

On 6/13 - RFE came in the mail for the vaccination supplement. It asked specifically for the varicella vaccine. The RFE was dated 6/9, same date as the inquiry

6/14 - liaison forwarded an email from the immigration officer letting her know about the RFE. The officer said we had 30 days to reply, RFE letter said 84 days. Ridiculous. I replied back to the liaison explaining I was puzzled by the RFE because we provided the ds3025 from his medical in London and I believe it to be complete. I pointed out where to find the varicella history on the ds3025 since uscis seem to think that is missing. Liaison responded that we should just comply so I thought that was it

6/15 - got 2 case status updates. The first said "RFE response received" (we hadn't replied yet) and immediately after status changed to "new card in production." Husband and I freak out and are confused.

6/16 - liaison forwarded email from immigration officer saying that uscis re-reviewed the file, approved the green card and we can disregard the RFE. I'm pretty sure the liaison forwarded my email or responded back which prompted uscis to look again and realize the RFE was in error.

Moral of the story, this ended up being a great way to challenge what I believed to be an erroneous RFE. We planned to go forward with providing a new vaccination supplement from a civil surgeon, while inquiring with the liaison at the same time, but uscis did the right thing.

Hello everyone,I went to my interview with my husband on 06/13/16. Everything was going smoothly until the interviewer asked if we had met each others parent. I met his father, his mother doesn't like me and and every time we plan a trip to visit my mom something always comes up. Anyways the interviewer asked for our evidence and I gave him our joint bank statement. He then asked if I had other bank accounts and I said yes,2. So I got an RFE asking for my 2 solo bank account statements. The problem is I let my mom and sister use them, so they are showing transactions in different states. What do I do? I need some advice.

I don't think that should be too much of a problem as long as you explain it all. You want to just be very honest and transparent.

After 264 days (almost 9 months) we FINALLY got our AOS approved. I was getting nervous.

10/08/2015: AOS packet sent to USCIS (Chicago lockbox) via USPS Priority mail (They received it 10/10/15).

10/16/2015: Text/eEmails received from USCIS with receipt number. We received 3.

10/22/2015: Received hard copies of NOA's for I-131, I-765, & I-485.

11/01/2015: Got NOA for biometrics appt (for 11/12/15).

11/03/2015: Did WALK IN biometrics appt - took 15 mins. Person taking said work permit should be in mail in less than 4 wks.

12/09/2015: Got email/text notification for INTERVIEW date.

12/28/2015: Got email/text notification EAD card has been mailed.

12/31/2015: Received EAD/AP card.

01/11/2016: INTERVIEW (in Los Angeles office).

01/11/2016: Case in in "CONTINUANCE". Awaiting approval. (Feels like AP).

06/27/2016: I-485 APPROVED - (FINALLY!!!) / 264 DAYS (8 MONTHS 20 DAYS)

07/01/2016: GREEN CARD RECEIVED
