Birth date verification and legal presence requirements

The issue of identification reliability, integrity, and confidentiality is of prime concern to all citizens. Eligibility for government services, issuance of various licenses, assessment of taxes, the right to vote, etc., are all determined through evaluations based on identification documents. It is critical that identification documents be authenticated and accurate in identifying each individual. The California driver license and ID card have been declared as primary identification documents in this state by the California legislature.

State law requires every applicant for an original California identification (ID) card and driver license to show verification of birth date and proof of legal presence within the United States to help safeguard the accuracy and integrity of departmental documents.

If your current name no longer matches the name on your birth date/legal presence document, see "True Full Name" and "How to Change Your Name" for more information.

Only the original or a certified copy of one of the following documents is acceptable:

  • Permanent Resident Card
  • Temporary Resident Identification Card
  • Canadian Passport/Birth Certificate
  • Non-resident Alien Canadian Border Crossing Card
  • Valid foreign passport with a valid Record of Arrival/Departure (form I-94)
  • "Processed for I-551" stamped in a valid foreign passport
  • Permanent Resident Re-entry Permit
  • Refugee travel document
  • Employment Authorization Card
  • Valid I-94 stamped "Refugee," "Parole or Parolee," "Asylee," or Section 207, Section 208, Section 209, Section 212d(2), HP or PIP
  • Valid I-94 with attached photo stamped "Processed for I-551 temporary evidence of lawful admission for permanent residence"
  • Notice of Action (I-797 Approved Petition) - must indicate approved extension of stay or change in status that grants temporary or permanent residency, or indicates that an original, duplicate or renewal Resident Alien card is forthcoming.

Thank you a.t.j24 and perfect! :)

You may get your GC before it expires but just in case there's a delay, apply 3 months in advance of the expiration date on your H1B.

Service request was completed and they sent us a response yesterday. I guess now we wait to see if our status changes today and if not, can we assume the result of the service request is "still processing, keep waiting?"

I filed on October 27 and my I485 still says "fingerprint fee received", and looking at the two possible offices close to me they are working on cases from April and march!

If say my case isn't approved due to a rfe would that be something i should be able to see on the app? Where it says "case received"?

Yes, you would have a status change to "RFE mailed" if you had one.

Hi,

Any early October submitters from Alabama/Georgia? My current status for AOS online states:

"On October 6, 2015, we accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or to Adjust Status, Receipt Number MSC************. Our National Benefits Center location is working on your case. We mailed you a notice describing how we will process your case. Please follow the instructions in the notice."

No updates have arrived by text/email/physical/mail/online about AOS. Feeling pretty in the dark about when to expect even an acknowledgement that they are "ready to schedule an interview" as a few people seem to be getting notice of. Anybody in a similar position?

October 2 2015 - Submitted I-485 and I-765.

October 6 2015 - Application received at Chicago Lockbox

Approx October 16 2015 - Received biometrics appt.

October 28 2015 - Biometrics appt.

December 26th 2015 - received EAD card and letter in mail.

Does your case status say, "Our National Benefits Center location is working on your case." somewhere in your message? If so, then you aren't at the field office step yet. You may get an interview waiver, as most K-1 AOS'ers get interview waivers since they had an interview at the embassy and you will probably get an interview during ROC. It seems earlier, people were getting Notice of Potential Interview Waivers (NPIC) but these later cases don't seem to get them. It seems that USCIS sped up and streamlined some of these later steps, but that's just my theory, so take it with a grain of salt.

Hi,

Same to you. If you don't get an update that you are getting an interview, that's not necessarily a bad thing. You still might get an interview, but my best advice is that from what I've seen, after you get your EAD, try to forget about GC. Some people get their GC faster, some much longer. I have seen some timelines that they didn't get their GC until after a year of their NPIW!! It will come, but whatever wheels are going on over there determine when/if the case gets sent to a field office and when the GC gets issued. If the case is still at NBC, then you aren't at the interview stage. If you get an interview, then the case is transferred, but if you are a K-1 beneficiary (and have been married less than a year), you won't need an interview to get a GC.

When will the GC get issued? Well, how long is a piece of string?

Signature coming soon...

Does someone know anything related to health insurance? My husband can't add me to his. Every insurance company he has checked told him I need to be a permanent resident to be able to get covered.. we wanted to get it before the interview so we can bring that as another proof of our legit marriage. . The enrollment period to get insurance finishes this month and we don't know what to do.. anyone can help us with info about this? Or know if there's another forum about it ? I will highly appreciate any help with info.. thank you!

There should not be a problem adding you on his insurance. I am currently enrolled through the aca on my wife's insurance. You have 90 days to provide paperwork as to your status in the US. I797,I-94, copy of visa uploaded right through the site.
