Timeline

According to UPS my AOS package was delivered on Friday, Oct 2nd but I haven't received any email/text yet.

did anyone got any response from USCIS?

Can you please advise what I need to send with my AOS package. My wife is here in USA on tourist visa and her 1130 was approved 28th sep. As per visa bulletin we are eligible to send AOS paper work too. earlier I had opted a consular processing for her case in India. But now I want her to apply for AOS here. please assist.

Re:Application for Adjustment of Status- I485 instead of Consular processing-

Dear Sir/Madam,

I had submitted an I-130 petition for my wife under the F2A category on Dec 30th, 2014. This I-130 petition was approved on Sep 28, 2015. At the time of I-130 filing, I had requested for a consular processing for her case. However, recently it was published on the USCIS visa bulletin for October 2015 that an individual could apply for Adjustment of status under F2A if he/she is in the US on a valid status.

As applicant is currently in the US till the 22nd of November 2015, I would appreciate if you can consider our request to allow her to adjust the status here instead of going through the consular processing.

I have enclosed the displayed documents below along with this cover letter. I appreciate all of your help and acknowledgement.

  1. Fees-check of $1070
  2. Oringal signed forms i-485, i-765, i-131
  3. i-864 –signed by petitioner
  4. g325a-applicant
  5. i-693 applicant medical form to be submitted during the interview.
  6. 6 photos- of applicant
  7. Birth certificate: Copy of the affidavit of birth by Pragati’s Parents & her School records stating birth date. Orignal will be submitted at interview
  8. Marriage certificate copy
  9. Passport copy- Applicant & Petitioner
  10. Petitioner-Green card copy, Driver’s license copy, SSN copy-Applicant & Petitioner

Hi agmehta,

If you want to switch to AOS, you should call NVC (National Visa Center) to stop processing your case for counceller processing. Call them in early morning, they are very busy.

Next, You should call USCIS to ask what steps you need to do to switch to AOS. Most probablely, They will just tell you to send your AOS package, but no harm in calling them to confirm.

  1. Fees-check of $1070
  2. Oringal signed forms i-485, i-765, i-131
  3. i-864 –signed by petitioner (Must include your Federal Tax returns for last 1 year with all W2s. If you can you should submit 3 yrs. tax returns. You may also need to submit other proofs of income. Please read all instructions of the forms very carefully)
  4. g325a-applicant
  5. i-693 applicant medical form to be submitted during the interview.(you need to submit it with I-485 in a sealed envelop signed by civil surgeon)
  6. 2 photos- of applicant(for I-485)
  7. Birth certificate: Copy of the affidavit of birth by Pragati’s Parents & her School records stating birth date. Orignal will be submitted at interview. (I don't know if they allow affidavit and school records as replacement for birth-certificate, So I would suggest you submit a copy of birthertificate to avoid delays later on. You dont need original as of now. If its in language other than english just attach a translated copy as well. When you check the status on the USCIS site with the receipt number it says "payment was received"

How can you check if they cash it or not??

We did it via money order, you can see of they've cashed it or not by money order receipt tracking number.

Wait till you get the three receipt numbers from USCIS first and depending on how you guys sent the payment you can track to see if they've cashed it.

Weird thing is after I received the three receipt number I quickly checked to see if they've cashed the money order but they didnt :/ later that day they've cashed it. Lol
