I'm U.S. citizen. I sponsored my fiance to come to US on K1 visa. We got married and unfortunately, we are getting divorced. We have not applied for the Adjust of Status yet.


What are my obligations as a sponsor? Will my soon to be ex-wife need to leave the county within 90 days listed in I-94 on k1-visa?


Is she allowed to stay while the divorce case is still pending? please advise?


What are somethings she can do to stay in US? Will I be responsible for her while she stays in US?

Without Adjustment of Status with you she has no way of staying.

She cannot stay longer then her 90 days. She doesn't need to stay for the divorce.

You have no obligations as a sponsor as that form is non binding. It would be nice if you did get her the ticket to go home though.

Since no AOS was filed she must leave by the date on her I-94 or she will be out of status. She can only obtain a green card (without leaving the US) by you cooperating with filing the AOS or VAWA. Beware of being alone with her as she could make false claims of abuse and obtain a green card that way.

You are under no obligation to support her beyond whatever the family/divorce court orders you to do. She does not need to be in the country for the divorce to proceed.

Make sure she dont mingle with her friends, they are going to teach her some trick to file VAWA.

Always have someone with you all the time, NEVER STAY ALONE WITH HER. she might knock her head to the wall and call the cops on your.

This way you get sued, you pay money, and she get the green card for free.

True story of close friend of mine. He paid alot of money for her medical bills, paid her money to sue him, and etc.

Please buy her return ticket, dont leave till the plane take off.

You just dont know, K1 visa can turned into instant green card on your cost.

Not everyone is as bad as you state, you are stereotyping everyone. You are not part of story so please stop, a lot of people are divorcing in good term.

NancyNguyen: There is no where i mentioned everyone, Do you think OP should not be careful? And let her file VAWA? I am the part of story because my best and close friend lost everything to this type of k1 visa thing. I will say it truly Majority of K1 visas people are truly genuine and deserve all the benefits. But there is possibility of getting into wrong person as well. Prevention is better then cure.
