Hello VJers!

My fiance received packet 3 this past week and we were reviewing the copy of the approved I-129F petition that was filed.

On the approved I129f under remarks, hand written it says "First filing. Bene was previously refused entry. Please address discrepancies with previous intent."

I wondered what this meant? My fiance hasn't been refused entry and had no problems travelling on his B1 visa. Although he did have the b1 in lieu of h1b declined. However since then he has successfully obtained a ten year B1.

Since it wasn't flagged, and we weren't asked for further information (RFE) does this mean it has been ignored? or will it be addressed in the interview?

Any advice or guidance would be greatly appreciated!

He has medical on Oct 9 and hopefully we'll get an interview letter soon after!

Just go to the interview and if they ask about it, tell them it didn't happen. Even if he overstayed, it wouldn't affect the visa. This couple had a recent interview and overstay. PM Sunya if you have questions. http://www.visajourney.com/forums/user/187224-sunya-and-tim/

Hey Jess&John, just saw your post and Nich-Nick's comment. More than likely it will come up at the interview but just be honest.

I want to make sure I understand. John applied for a H1B visa and it was declined so then he applied for a B1 to travel to the US for business. If that is the case then it should be a non-issue. As in Tim's case even though he had the overstay they gave him a B2 visa that he has been traveling on for the last 2+ years. Tim normally gets pulled to secondary checking at POE to get a lecture about not overstaying again but other than that he has never had a problem and did not have a problem with his POE for K1.
