I will admit, the Phils., is easier to get K-1's done than some other countries. But, they still do not miss much.,.,.this Japan police report was a terrible ordeal..,.,.,..but they got through it.

If you are trying for another K-1, you will get denied until 2 years has passed from your first petition.

This is completely false.

I was approved in 13 days after filing my 2nd K-1 less than 2 years from my first petition.

I wasn't sure where to ask this but to make a long story short..I had gotten engaged to a girl overseas. Got her the visa, she came here, we got married within 90 days and she ended up running away. I ended up getting that marriage annulled and my question is if I were to do this again with another girl, will I encounter any difficulties? If I were to get engaged overseas and attempt to get another visa

To be honest, you really shouldn't have any issues.

I was in a similar situation as you before with my last ex, who was my previous K-1. After 3 months of marriage she walked out on me. I met my wife and started dating her about a month before my divorce to my ex was started. The divorce ended up taking months, so during that time I went to Philippines for a couple weeks to meet my now wife. A few months before my divorce was final, we talked and agreed to marry each other. The day after the divorce was final I mailed in my I-129F petition. I had to include a letter requesting a waiver of the filing requirements, which was accepted and I was approved about 3 weeks after I initially mailed the petition.

There was no issue at all.

My wife had her visa interview a few weeks later. I was with her. The first consul, the Filipina CO, asked for all our documents and then asked both of us many questions regarding our current relationship. She also asked to see pictures of us together (we had 2 photo books). The second consul, the American CO (there were actually 2 but I think one was in training). They asked her very simple and light hearted questions, it was almost like a chit chat.

In the end, there was no issue at all at the embassy stage either.

Bottom line, as long as you can prove a bonafide relationship with your current fiancée, you should be just fine.

then when filing the 3rd one,

you must include a letter asking for a waiver from the rule.

Thanks for all the info. I will be filing my second k-2 in a month or two. This month will be 2 years since the NO1 of the first one. I will be sending a waiver letter In case is needed. I will also include as much as ongoing relationship on the petition up front in case. My country is a high fraud on visas unfortunately. I will be well prepare for the interview. thanks for all the info provided.

The scrutiny is on the petitioner,not just the beneficiary. Life happens. All you can do is be honest and realize that there will be more expected. Well prepared folks shouldn't have a problem.

Let me clarify. You will be denied unless you file a waiver. That's just IMBRA. Not my policy, it was made up by the USCIS.

IMBRA states you need a waiver if:

(i) You have previously filed two or more I-129F petitions; or

(ii) You have had one I-129F approved within the previous two years of the date you filed it.

If neither of those apply, no waiver is required.

I would still include a waiver request even though the policy is as described by Darnell and Hypnos.
IO's unfortunately don't always follow or interpret their own policies and I have seen RFE's issued when none was needed according to their exact

policy. A waiver request in one sentence is so simple to write, why not just do it and don't take a chance that your adjudicator will sit there scratching his head

and then issuing an RFE. There are several old threads in which this was discussed at length and the general consensus is : include the waiver.

AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
