Hello VJ family,

While preparing for our interview, we are getting worried because my wife ( the petitioner) is currently unemployed.

After working in Asia for the past 4 years , my wife contract got done one month ago .At the moment she's awaiting my interview before we can travel to the U.S. for her to get a job.

Her tax transcript for the past 3 years indicate how she's above the poverty line.

Should we be worried about being denied because of her not having a current income/job??

What can we do at this point??

It sounds like you need a co-sponsor. A typical co-sponsor is a family or friend. They also fill out the I-864 and you will need three year's of tax transcripts/tax returns.

Sounds like a joint sponsor situation also look at domicile.

Hello,

Thanks guys for your informations. We are currently stuck in having someone that will be a joint sponsor. Moreover my wife was thinking about showing bringing in her bank statement proving that she has 10,000USD and above saved.Is it relevant /can it help?

$10k is not enough, need to keep looking for a joint sponsor or she could come back and get a job.

If you applied while she was employed and you're at the interview stage, I doubt they are even going to ask about her current job.

If you applied while she was employed and you're at the interview stage, I doubt they are even going to ask about her current job.

Irrelevant, if information on the I-864 fundamentally changes from the time it is initially submitted to the time an interview takes place, an updated form must be submitted. Failure to do so is Material Misrepresentation which has serious consequences.

What Ryan H said plus one of the standard questions in the interview seems to be "what does your spouse work with/do for a living".

OP, you need to find a joint sponsor or show assets three times the federal poverty guidelines for your household size.

To the conversation in the thread: Even were Ulrichkkam's wife still employed at her job in Asia, that income could not be used to sponsor unless it is the rare bird that will continue after she moves halfway around the world to the US.

To Ulrichkkam: Your wife can sponsor you with current, continuing income (125% of the poverty level for household size) or assets (3x the income requirement).

If this does not go, look into a joint sponsor (same requirements) or she can look into finding and starting US employment before you move to join her.

As mentioned above, look into domicile if you have not already. It's another hoop to jump through for petitioners living abroad.

Thanks guys for y'all awesome effort contributions, we appreciate it.

In addition to our case , I made 18,000 of income already this year, excluding my pension rhat's coming in . So with my pension coming in, I'll be above the poverty line.

My next questions is can they consider my pension to be part of my income ?

When it comes to domicile? (1) I have records of payment when I went home for a visit, (2) Receipts from post office sending things home( same address as written on all my official documents,petition and Ds260. (3) copy of A renewed driver license with the same address on it.

Sorry guys for our complicated case , we're really looking for a way to solve this.

As for the joint sponsor , we're really tied .

As long as you can show it is US income or will continue you should be good to go.

Yes!!!

Finally we have a joint sponsor.

But I have some questions dealing with the affidavit of support. The independent joint sponsor will fill out the I-864 form, correct? Just like the petitioner fills out, right?

If the joint support fills their taxes out as married filing jointly, do both husband and wife have to fill out a I-864 form? The husband is the sole provider. The wife is a stay at home mom so she doesn't have any income coming in. But does she also have to fill out and sign a i864 form?

And do they need to include anything other than copies of their last three years of taxes and W2s and do I need to show their original birth certificates or would copies be okay?
