Latin american names

Hey everyone, I'm sure this question get's asked a lot and actually I've read quite a few post about this already but seem to have seen a few different opinions. My fiance lives in Mexico and therefore has both the last name of her mother and father. Her name for example is Anna Jole Garcia Gomez. Her first name is Anna Jole. Her fathers last name is Garcia, and her mothers last name is Gomez. I've read in some places that at the begging of the application put a note stating and explain that she has two last names one form her father and the other for her mother and that these last names will apear on her pasport birth certificate etc. But that for the sake of the application on the i-129F as well as on the g-325a and in the letter of intent I will use only her fathers last name. I've read to do this in several different places.

However I've also hear several different people say to use both her father and mothers last name throughout the application. What's your opinion? Anyone have personal experience with this?

Also while I was in mexico a month ago all I had read was about using the fathers last name. It wasn't until I got back here to the states that I heard people say to use both last names. While I was in mexico we filled out all the documents that she needed to sign and she only signed them as Anna Jole Garcia and left out Gomez. Could this be a problem?

You put both of the names in the last name field. Her last name has 2 names, not just one. You need to list them both.

I appreciate yall helping me. If yall could would yall mind reading this. It states that I can just use her father's last name if I understand it correctly. Can I do it that way?

My husband has 2 last names (Argentine) we used BOTH last names on EVERYTHING.

It has to match her DNI, and Passport. Whatever names she legally uses, much be the names you put on the paperwork.

I would agree with that. I mean it makes logical since. But is this a "MUST" or are there more than one way to do it? I mean if it is a MUST why in the FAQ section of VisaJourney does it state the following:

3.2.2)...How should a latin name (first name, fathers last name, mothers last name) be put on the G-325A and I-129F?
A..What others have done successfully is to use the first (fathers) last name on the forms. Then in the cover letter, state the full name including both last names and that you are only using the first (fathers) last name on the forms.

(The reason I'm asking is because I already have the g-325a filled out and signed by her but only using her fathers last name and in order for her to send me new signed formes could delay us anther two weeks and we would really rather not do that.)

You risk the G325-A not matching her records in her own country, and on her passport. It probably works in a lot of cases; but the issue at hand is do you want to take that risk?

I used both last names and had no issues, not a single RFE during the entire K1 and AOS process. I'm sure others only used one, and had no issues either.

Check the Mexican US consulate, likely they're the ones who'll be picky about it. (I believe it's Juarez?) There should be a forum specifically for Juarez, which may have more answers. I know Argentina wouldn't have approved anything if the paperwork didn't exactly match his DNI and Passport. They can't prove it's the same person.

I also used both of Mrs. T-B.-to-be's surnames. I would either underline the father's name (in your example, Garcia Gomez) or capitalize it (GARCIA Gomez). Either way leaves no doubt.

Should we write it that way throughout the entire application? As in on the letter of intent where it states "I, Anna Jole Garcia Gomez, do hereby..."

Even in this context would it be best to capitalize Garcia?

We used both everywhere and I put a note in my cover letter noting that we would be following the Latin American naming tradition. No problems so far.

Really, I think it is safest to go with what is on her passport and other documents. I was confused by that advice too and while it is probably ok as well.... it just doesn't seem "right".

Oh also, I don't think it would present a problem for you though. Just note it in your cover letter. Or have her send a new g325a. A week or two extra to feel safe isn't a bad tradeoff, to me. Especially at this point when you're probably only looking at a 16 or so week process from start to finish.

I have no idea, my husband's got a green card. Ours took FOREVER though.
