K1 Visa Advise Pleae

Hi all this visa business is very stressful and a long wait sadly.

My american fiancee has filed all the paper work in January. A few weeks later she called to see if they had received all the paperwork and was told there was a few problems due to getting incorrect information on the web. So she was sent a letter with an envelope to send back to Texas with all the correct information and additonal forms etc.

I am worried about how long it takes for the I129F to be processed and before they contact her regarding any mistakes.

I have the following questions?

1 Would be being the fiance in England be able to contact UCIS to speak about the application?

2 My fiancee says if she keeps pestering them it will make them take longer to work on the application (I don't know where she gets that from)

3 Anyone from The UK able to give me any advise on what to expect next?

So u sent it in, and they found problems, and you sent it back? Just watch for the check to be cashed to me thats the first sign it going on thru the process. Ususally ive seen with the RFEs it only will be a short delay, I doubt anyone calling them will change anything at this point.

My american fiancee sent the paperwork to the USIC people. I am english and I need to know if I called them I would be allowed to discuss the visa?

Hello and welcome to VJ!

You can look at the timelines on this website to get a good idea of how long it takes to file the petition...and ultimately how long it takes depends on which service center you apply to. As you are applying to the Texas Service Centre (and therefore the California Service Centre) you can look at my timeline to get a good idea of about how long it might take. But, if you go to the immigration timelines portion of this website you can see many many other timelines as well.

You ask if the English fiancee (or maybe the American fiancee in England) could contact the USCIS and speak about the application --yes. However, I haven't heard of examples where people call the USCIS to ask questions and I'm not positive if that is even allowed no matter where you are. Most likely if you did call they would just say, your application is within the normal waiting time so there is nothing I can tell you.

I'm not sure where your fiancee got the idea that pestering them would make them take longer, but as I said above, more than likely no matter when you called (unless your application had passed normal time limits) they will probably just tell you they can't give you any information. Of course, I have no idea what problems you had originally with your application, so maybe you are in a different situation.

But again, as you can see from my timeline, I'm in the UK so you can go by our timeline to get a rough idea! My fiance is Australia, but as we're living in the UK we do everything as if he was a UK citizen.

Think everyones getting confused who I am.

I am english and Im in England now waiting for the K1 Visa to get sorted so I an join my Amerian Fianncee Jenny USA and get married. She as filed all the paperwork in America.

Kinda similar to my last post...but to clarify -based on what you just said.

If you do not have a case number (which you can get on your NOA1 or the back of your cashed check) then no, you cannot call to talk about your visa petition. Without a case number they would only be able to give you general answers.

However, even if you do have a case number, like i said before, I'm not sure they would tell you anything (not before you are not the petitioner) but because they don't really tell anyone anything, minus what you can see online with your case number. Basically, at this point, everyone just has to wait and see what happens.

But again, I don't know what problems you had. I'd recommend just getting the papers in as fast as possible.

Do you guys have an NOA1 yet? Or have they not accepted your petition at all thus far?

just called her at work she said that she received a letter saying what else she needed blah blah with a envelope in it to send the required stuff back to them and that is all we have received from them.

IS the check cashed and who sent the request for more information. Usually texas will have for week or so then on to California for the longer wait, again u can also see from my timeline. THe first step is to get the check cased and get the case number off the back, its mostly a just wait and see thing, unless its very much over the time normals. Tell us who (them) is Texas or California

I think I have an idea what could be going on here.....JUST GUESSING!

I am pretty sure that when you first send in your application they make sure there are certain amounts of things in the petition. Cause I know they wont give you an NOA1 unless you have a check or money order attached to your petition. Maybe they also wont give you an NOA1 without a valid copy of the actual petition form or something. So MAYBE they forgot to include a check and/or actual I-129F form or something. So, on seeing that TSC just returned package to sender and asked that they include everything that is asked for in the petition...

Cause how it sounds to me is that they have not yet received an NOA1 and have not gotten a check cashed...in which case they wouldn't yet be receiving an official RFE -as that would come much later.

Just an idea of what could be going on here...! :luv:

She paid by money order and when she called to check to see if it had been received they said there was incorrect info on there website and apolgised and sent her the stuff back asking for more info and a prepaid evelope. That was like over two weeks ago and we have not heard anything since.

Its just so stressful :crying:

OK again, you sent to Texas, they reviewed and found some things missing so they returned to her and ask for more info and to return in their envelope. (right so far?) if that is so how long ago would they have rec'd it? (the second time) if your paying by check u can get the number from the back, if money order im not sure of tracking then you would only have to wait until the notice comes assigning your case number and saying they have rec'd and started processing. Texas is normall i think a week to 10 days. I just looked at my notice it says mine was rec'd Nov 14, notice date Nov 21, envelope says post marked Nov 24, and gives my case number so how long past this (normal) time is it since they rec'd the amended information that wa (re sent)

Let's be clear here... your USC fiancee has not filed for a visa for you. She has filed a petition to determine eligibility to apply for a visa. May seem petty but there is a big distinction. Actual visa application does not occur until after the petition has been approved and has arrived at the consulate. At this time you will submit the DS series of forms which is the actual visa application.

As far as I know, only the petitioner (or petitioners designated representative) is allowed to receive information about a particular petition. Even if your petitioner contacted the USCIS the amount of information provided is negligible. You will not be provided an opportunity (at least to the best of my knowledge) a change to speak to an adjudicator regarding your petition at any time during the process.
