Next Steps - Got I-129F and 130 approved

Hi,

Just wanna know what's the next step ?

1.) Just rcvd the letter from NVC saying I129-F has been approved and papers will be sent to consulate in India

2.) Also, rcvd letter from INS saying I-130 has been approved and will forward the paperwork to NVC.

I'm just not sure what to do next. Also, if I go through K3, then what are the next steps if I decide to pursue further process in US.

Since both I-129F & I-130 were approved now Wait & see which application reaches the conslate 1st...most likely it'll be I-129F for K3 visa...

if its I-129F, then go for K3 visa

if its I-130, then go for Immigrant Visa

soon your spouse will receive the Instructions from conslate either for K3 or Immigrant visa...Inthe mean time, start preparing for supporting documents such as, tax return, bank statements, pay stub etc...

The I-130 once it arrives at NVC will take at least a couple of months before it will be completed at that stage (See the NVC Flowchart for CR-1) Your I-129F on the other hand you have received notification that it is being forwarded to embassy.

Choices

1. If you are wanting to adjust status in the US from a K-3 visa, one doesnt have to do anything else with the I-130 except to wait for its approval and it already is.

2. Continue with the I-130 at NVC stage as if you were going to apply for a CR-1 (NVC Flowchart) but still enter the US on a K-3 visa. You then have a choice to either adjust status in the US from the K-3 visa, or return to country of resident for the CR-1 interview once it has been completed at NVC and forwarded to embassy. Lots of members have taken this option particularly when the country of residence is not too far away, as it is a lot less hassle then AOS in the US.

3. If an I-130 petition is close to completion at NVC and or arrives at the embassy before or at the same time as an I-129F petition........the I-130 will over-ride the I-129F. This is unlikely in your case as the I-130 is still at a minumum a couple of months from when it would be completed at NVC.

If you have entered on a K-3 and continued the processing of the I-130 at NVC but decide in the end that you wish to adjust status in the US, you can notify NVC of that in writing.

Choosing the K-3 - Start gathering together all that will be needed for the interview. A complete copy of the initial package sent. Original Certified Copies of any documents sent as photo copies.
