My fiance got here last week and now we are starting to thinking of moving our marriage up from the end of April to sometime in February. I would really appreciate it if someone could tell me what the process will be. If we were married say February 14th - what do we do next? and how fast do we have to do it? Will the I-864 need to be submitted right away or do we wait until our interview - like with the I-130? If anyone has processed through St. Paul and could give us an estimate of how long it took from the time of submission until their interview that would be great too! Thanks for all your help!

May 11 '09 - Case Approved 10 yr card in the mail

June - 10 yr card recieved

Feb. 19, 2010 - N-400 Application sent to Phoenix Lockbox

April 3, 2010 - Biometrics

May 17,2010 - Citizenship Test - Minneapolis, MN

July 16, 2010- Retest (writing portion)

October 13, 2010 - Oath Ceremony

It seems the St Paul office is taking 212 days from filing to the interview based on 10 other users data. Look under Immigration Timelines AOS.

You can file as soon as you receive a copy of your marriage certificate. Below is a wonderful list Tom made up and has helped me out greatly:

AOS: A check to USCIS for $385 (combined AOS and biometrics fees)

Form I-485

Form G-325 (4 sheets)

Notarized form I-864

Letter from my employer

Recent pay stub

Federal tax returns for 2004, 2003 and 2002 with W-2s attached (adjust this for the years you need)

Two passport style color photos

Photocopies of: The passport name page, visa page and I-94 (both sides)

Marriage certificate

Birth certificate

Vaccination Document worksheet

I-797 approving the K-1

EAD: A check to USCIS for $175

Form I-765

Photocopies of form I-94 (front and back)

Two passport style color photos

AP: A check to USCIS for $165

Form I-131

Photocopies of her passport visa page and the I-94 (front and back)

A letter stating her need for the AP

Two passport style color photos

After marriage, you have to file for AOS (I485), EAD (if he wants to work before he gets his green card..), and AP (advance parole, if he wants to leave the country before green card..) The I-485 will tell you what else you need to send in with your application (but yes, the 864 does need to be sent in with the original application..) You do have some time to do it (apparently its 180 days after the K-1/I-94 expires) but its recommended to get it done as soon as possible (the sooner you send it in the sooner it will be processed..) Just want to mention to anyone who is using lists from here (which are very helpful!) to make sure the fee amounts are correct. I used a wonderful list that someone posted but ended up sending in the wrong amount for the I485 because I was going off the list and not off the USCIS instructions.

May 25, 2005 - Lee arrives in Los Angeles

August 7, 2005 - Got hitched in Paris via Las Vegas! Lee's parents came from Perth, Australia for the occasion

August 22, 2005 - Medical Exam done

January 9, 2006 - Sent in AOS packet (I-130, I-485, I-765, I-131 sent accidentally to TSC instead of Lockbox)

January 17, 2006 - Received packet back from TSC

January 18, 2006 - Sent packet off to Lockbox

January 19, 2006 - Received by Lockbox

January 30, 2006 - Received NOA for I-131, I-485, and I-765

April 21, 2006 - Biometrics Appointment

May 10, 2006 - Sent RFE to USCIS

May 19, 2006 - AOS, I-131 and AP all touched

June 8, 2006 - AP approval e-mail received, case "touched"

June 8, 2006 - EAD touched again

June 15, 2006 - AP arrived

June 16, 2006 - Notice to appear for initial interview arrived .. we can't believe it.

July 24, 2006 - Interview. APPROVED! Hooray! (Didn't even ask about why he came in on VWP)

Start to get together all the materials you need (lal_brandow has a good list) asap! Especially go and get the vaccination suppliment right away. We waited on getting that until after we were married and it took them almost a month to get the paperwork filed.

If you have everything together, then you can send it in as soon as you get married and have a copy of your marriage certificate, which you can get right away if you actually physically take the signed papers from who ever performed the ceremony directly to the place they need to be, rather than send them in via mail.

The sooner you get married, the sooner you can turn in the AOS/EAD, and by extention, the sooner your dh can start working.

As for Saint Paul, as far as I can tell, they suck. Haven't gotten a bio appointment yet, no indications of an interview, bah.

07/15/09 - Citizenship ceremony. Alhamdulilah, the US now has another american muslim!

You do have some time to do it (apparently its 180 days after the K-1/I-94 expires) but its recommended to get it done as soon as possible (the sooner you send it in the sooner it will be processed..)

Technically, your fiance starts accruing overstay the day after his I-94 expires. The overstay "clock" stops as soon as USCIS has accepted your fiance's/husband's AOS application. He can still apply for Advance Parole and travel overseas as long as he has not overstayed for more than 180 days.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!
