Timeline

Pls I need urgent advice regarding my predicament.

I got my spousal visa 3weeks to my second wedding annivesary and I wait till 6 days after my second wedding before I arrive in te US and I got cr1 status on my passport and I receive an Ir1 status on my green card for 10yrs.I have only been in the US for 2 months a 3 weeks!

I realise my wife is a different person and we do not get along, and everytime we have issues she threatens to revoke my green card.

I'm tired and want to opt out of the marriage.

I"d like someone to explain if I can get out without getting into trouble.

She's lying because she can't do that. So don't let those threats bother you.

If the marriage isn't working then divorce and move on. Whether you stay in the US or return home is up to you.

Nothing is going to happen. You don't have to worry about anything. I didn't live with my wife for a single day and I am on IR-1. You don't have to get divorce though, try to talk to her and go for counselling if some one is treat you this bad. Don't live in fear. Sorry to say but some of the USC don't try their spouse right, they think since they apply for visa for their spouse they have done a very big favor on them, as if it is ticket to haven whereas it is not so. Marriage doesn't work with threatening. If she thinks she can treat you as if you are her slaves, tell her it is not going to work because US government treat people right and helped immigrant with their proper rights. Hope you have better life. Life is very short and I believe you get one life. Cut your loose.

Sorry to learn that only a little over 2 months into actually living as a married couple, you already want out. Some will suspect you never wanted in, and could be using abuse as an excuse to move on now that you have your green card. 2 months is just.....wow! Whatever the case may be, I hope you have a good life in the USA and enjoy it as much as you have dreamed.

Just barely 3 days when I got here my bags were thrown out and 7days after I was left without food for a whole day and I have been made to walk 5 miles to get home because she wouldn't give me a ride..it goes on and on

So sorry to read about this. Its just sad how you can go through this whole process (which takes time, patience, love, money, effort, pain, joy and every single feeling you can think of) just to realise it was not what you expected or what you deserve. I cannot give you expert advise about your legal status as I am not an immigration lawyer or do not know enough to give you the right answer. What I can say is what I would do: I would try to get counseling and see if my relationship can still be saved. If I married this person it was because I knew them enough to have an idea of what the outcome would be. (But yet... it takes time to get to know a person for real and some people are not... lets just say... honest when they meet you) If this fails I would pack up and move back to my home country where my roots and family are, count my losses and move on. There might be other ways for you to stay in the States after a divorce. Just do your research. Here in Visajourney we have a lot of willing to help members you can ask. Your marriage is still fairly young, and if you both value it try counseling and making it work. If it becomes unbearable then divorce and move on. By the way there's nothing your wife can do to revoke your green card or deport you its on the government that can and that's if you commit a felony. If you had a 2 year green card, her threats or action of divorce would've been problematic to your status as you would've had to remove conditions with her or file a waiver alone and prove bona fide marriage. Respectfully let her know there's nothing she can do to revoke your residency and ask her to focus on making this marriage work. Sometimes this can be the perfect antidote to make her more reasonable in dealing with conflict resolution, as her illusion of power over you is fueling this tension which might just ease when she figures out the reality of it. The only time such a quick divorce trail may follow you is when 5 years down the road you decide to naturalize. The interview officer then might scrutinize your application and demand answers and bona fide evidence about your prior marriage to make sure you didn't circumvent immigration law just to procure a green card and divorce your wife. However your case will be approved if you do happen to satisfy the requirements at that time if demanded.

OP has a 10 year green card so divorce doesn't affect his residency nor ability to reside in the U.S. It' might however raise questions of bona fide marriage at inception during naturalization process years later for added scrutiny.

Hard even for a USC spouse to claim that the marriage wasn't bonafide after 2 years. She had lots of opportunities to do in the last couple years had she wanted to.

She's on the hook for him, no matter what his motives may or may not have been, so she's blowing smoke if she thinks she can revoke a green card at this point.
