Hello everyone one I entered the USA with b1/b2 visa I got married here in usa my wife she's 19 years old so she don't do taxes untile next February.I'll send my paper work next week and I did explain to the USCIS the situation but I'm still scared another thing she have been working for 7 month now do I have to put the annual income from the last job? please help me and thank you.

Your US citizen spouse should prepare all the needed documents. When you return to your country you will have an interview at the US embassy for your immigrant visa.

There is no explaining. If your spouse's current annualized income does not meet the requirement then a joint sponsosr would be needed.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Thank you sir I really appreciate it her income is good the real problem is the taxes she's 19 years old she didn't do taxes before she was in her mom taxes.

First, whether she was claimed as a dependent by someone else is independent of whether she filed taxes. She could be claimed as a dependent and also filed taxes. Whether she is required to file taxes herself depends on her income. The only reason she can not file taxes for a particular tax year is if her income is less than her income threshold for filing for that year (found at the beginning of that year's Form 1040 instructions). This has nothing to do with whether she was claimed as a dependent by somebody or not. If her income was lower than the threshold, then her not filing is perfectly legit and there is no problem.

Depending on what she earns from her current job she may or may not need a joint sponsor.
