Hi Vj's!

I just filed my I-360 and I-485 concurrently with the help of my advocate. USCIS gave me a Prima Facie Notice and just waiting for a decision. I was about to file a divorce on my husband but the lawyer said i am already annulled based on the records of the county where we got married. The good news is, I don't have to file for a divorce but the bad news is that the ground for annulment is due to fraud on my part. How is it going to affect on myimmigration application? Is there anything i can do to amend/alter the judge's decision? Because i strongly believe that our marriage is bonafide, it is just that i don't have enough evidence since we have been together for 5 months only and left him due to abuse.

You are going to have a very uphill battle. Without a bona fide marriage your I-360 cannot be approved, since that's one of the VAWA requirements. Annulment due to fraud by you is going to make it almost impossible to demonstrate that your marriage was legitimate.

? i had a bad feeling about it too. Is there anyway i can do?

I have police report and journal. That is all i have for abuse. As for proving our marriage we don't have joint accounts or properties because he doesn't have one.

If you cannot prove a bona fide marriage then you do not qualify for relief under VAWA, sorry.

If you committed fraud to marry him what is to say you aren't committing fraud by alleging abuse to obtain a green card? I am not saying you are I am just saying it will look that way. If the marriage has been annulled there is not a lot you can do, no marriage, no green card.

Im sorry you go through all of this. I agree one of the comment here that no married, no green card. You are still in adjustment of your status. This is really tough situation of yours. You can choose either to leave the country or stay but if you stay finding a decent jobs and decent life it will be tough too. I hope you will find a better way to handle this immigration stuff. Bonafide proof of marriage for U visa...USC seem to have annulled & report it as fraud first

essentially there was no marriage

U does not require marriage.
