Hey,

I'm Filing concurrent I-485 and I-130 tomorrow and quickly want to double check if my spouse earnings of $20137 in 2014 is enough to satisfy the 125% poverty guidelines?

I'm nearly sure it's just over the limit but would be keen to hear any other views on this.

Also will they also ask for 2015 returns next year as I'm assuming my case / meeting etc will be during the middle of next year if approved!

They're not currently working. But isn't required to file for 2015 taxes until March so will that matter?

You may want to get a co-sponsor....not to freak you out but in Montreal at least, they've been denying VISA's even if you're a slightly over (by like $1000 or $2000).


My personal opinion and advice would be to seek a co-sponsor since you're so close to that line either way. That's what we did cause we feared even if my wife was just over, they would deny us....

Better to be safe than sorry :)

But that's up to you. You could also try to pair assets (home, savings, investments) to try and meet up with the guidelines as well, but I'm not 100% how that is done. Co-sponsor is usually the easiest way to go about things.


Again this is MY personal opinion, others may have better insight.

2019 UPDATE Going Home to Canada. Process for their application took 4 months. Smell ya later USA. Won't miss ya.

Current and continuing income is what is evaluated, not only the past year's income. Now if the petitioner/sponsor is self employed the income evaluated is line 22 of the most recent form 1040 tax return.

Why not use Google to find the exact income requirement rather than hoping and guessing? Search for I-864P and check under the 125% heading.

The current I-864 guidelines (125% poverty threshold) are available here: http://www.uscis.gov/sites/default/files/files/form/i-864p.pdf. Assuming there are only the two of you in your household, last year's income you list from your sponsor passes the threshold. However, as other posters mentioned above, this by itself might not be sufficient if the person is currently unemployed. It is probably best to secure a joint sponsor who can show continuing (not just present, but future) income in order to make the strongest case for your application.
