An unfortunate update, since October my fiance has been waiting to be contacted as to when he can go back to the embassy for a follow up interview. He emailed the embassy after weeks and months of not hearing anything and they assured him that he will get a phone call soon. More time passed so he emailed them again and they said it is processing and he should continue to wait. Now in the new year, its been four months so he sent another email and they responded by saying there is no further action to take as he is not eligible. They said that he must email the embassy in August for more information. That was it. No reason as to why he is ineligible and no mention of his approved waiver or medical that was submitted. We are devastated to say the least. August is when the application expires. So if he is not eligible and has to wait until August to email them again does that mean we are back at square one? We have to reapply and pay all those fees again? We are so hurt and confused.

This so is confusing. Your waiver was approved yet the embassy is still saying he's ineligible? Then why did they send him to do another medical? What's waiting until August going to do? Is that a ban of some sort?

This makes no sense to me. I'm so sorry this is happening to you! Did a lawyer do ur waiver?

My sentiments exactly! We are beyond confused. No we do not have a lawyer. He processed the waiver himself. And it was approved. He completed all the additional steps they requested such as re-doing the medical and attaining another police report. I can only assume they are giving him a one year ban due to admitting to past marijuana experimentation. But if that is the case shouldn't they convey that information? Doesn't he have the right to know why?

You would think but they like to treat us like we don't. I would contact your congressman. The ban should've been able to be served simultaneously with applying for the waiver. Ours was.

I'm so worried about this. I truly hoped after getting the waiver approved the worst would be over.

Wow. We are devastated to say the least. I will definitely get in touch with my congressman. Thanks. My fiance emailed the embassy again asking for an explanation and they set a date for him. Any advice on that? We are so leery of how it will go seeing as that he literally begged for this appointment.

If he has a one year ban for prior use why would they have him redo his medical already? How could he process the waiver himself? The waiver is about your hardship without him. It has to come from you the petitioner.

Your timeline isn't filled out. When was his first interview. When was the waiver filed? When was it approved?

I'm totally confused. I'll be anxious to hear what happens at the interview.

We were just speculating on the one year ban. No confirmation as to that yet. The waiver was done to excuse a fist fight that he was involved in at the age of 19 that came up on his police record. The embassy told him to file a waiver to prove that he is not violent and is a reformed individual. I also wrote a letter of hardship to send along with his waiver as evidence. The first interview was in August of 2014. That is when they saw the assault charge on the police record and deemed him ineligible and told him to do the waiver. He processed it in September and received his waiver approval notice in July of 2015. Shortly after the embassy called him and instructed him to do another medical, attain another police record and make an appointment to go back to the embassy to be "re-sworn in". However, during the medical questioning, he conveyed that he tried marijuana in the past and that is when they sent him to the psychiatrist. But he also told them that during his first medical examination and they never sent him to the psychiatrist then. Anyway the embassy emailed him stating that they received his medical and psychiatric evaluation and that they are processing his case and he will be contacted in due time. This was in October of 2015. He waited and waited but no one contacted him. He sent numerous emails and the response was wait for a call that will schedule your ur follow up appointment. Then late December came and he still didn't hear anything so he emailed them again and that is when they said he is ineligible. No explanation or further information. Just that his ineligibility will expire August 2016.

Oh ok got it. Your timeline isn't completed so I was thinking his first interview was in 2015. Sounds like the embassy messed up not giving him the ineligibility after the first interview because his ban would already be finished. not sure why they didn't send him to psychiatrist the first time.

Sounds like a frustrating mess. Hope he can get it straightened out. You've been dealing with this a very long time just like us!
