Hi all, i just got a letter asked for more evidence for good faith marriage, i already submitted our driver's license cards & vehicle insurance for both card with our names on those cards. And how come the USCIS C/O didn't see those copies, it kinda pissed me off!

now one of the examples for the evidence includes 2 of them above

I submitted tons of evidence such as : our driver licenses, our vehicle insurance cards, copy of beneficiary, 2 bank statements, utility bills since i came here with my name on it, greeting cards, medical insurance, tax paperworks, 3 letters of affidavit, tons of pictures

Our mortgage is not with my name on it because my husband bought the house before i came here. And the credit card with my husband name on it only but i can use them, so how do i proof it to USCIS about it?

Any input would be very helpful, thank you

They need to see ongoing eveidence from when you were married to current date.

Did they ask for more bank statements? You said you included only 2. We sent in every bank statement for all the different accounts since the time we were married. I added my husband the week after we got married here in the USA so we had statements going back three years.

Insurance statements also from when we were married to current date including, car, apartment, and health insurance (cards and statments) was another item we included.

They want to see bank statements from the date of your marriage to the present time (if you opened a joint account then). Two bank statements is probably not enough. Be sure you copy ALL pages of the bank statements.

Also - every couple should have wills and medical power of attorney paperwork. That would help.

If you DON'T have something (like only one spouse is on the mortgage), then you need to explain why.

If your husband has a credit card, and you are an additional holder - he should have a card with HIS name on it, and you should have a card with the same account number with YOUR name on it. Photocopy the fronts and backs of both cards.

I own the house we live in. Because there are no marital tax benefits for the house for my spouse as long as she is still an LPR, I am waiting to change the deed on the house until she becomes a citizen. But I have willed her the house in my will. When comes time for us to submit our ROC package, I will explain this in the cover letter.

Good luck.

Thank you, Yes i did sent pile of bank statements from our 2 different banks from long time ago until the month we sent the package on April. and No, they don't asking for bank statement on the examples list.

and yes i did sent our ID driver license cards, vehicles insurances, home insurance, medical insurance cards & lease of agreement purchase furniture with our names on it.

But it seems, they didn't get those copies that i sent, should i just resubmit them again by saying re-submit?

Thank you for the comment. They asked copies of CC, driver license, insurance such as life, vehicle insurance etc. And loan documents & copies of rental/ lease agreements showing joint tenancy at a common residence signed by you, the petitioning spouse & the owner(s) of the property ( property manager ) >>> what is this exactly they asked? because we don't lease/ rental any property

We Were thinking to put my name on Credit cards as an authorized user for this RFE and resubmit some evidence that we already sent to them ( the insurance cards, driver license and some recent evidence )

OP, these instruments would help you perhaps more than anything else. They're even more valuable in "life" than as ROC evidence.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

OK - what you have typed in red is what I was talking about.

They have asked for evidence that the two of you live together. So you have to satisfy them.

In your cover letter, you say that your husband purchased the house prior to the start of your relationship, and that his name is on the mortgage. If the follow is true, you may say this: In order for <beneficiary's> name to be added to the mortgage at this time, it would require that the loan be re-financed, which would result in a financial outlay that is not currently possible.

You then include the settlement documents from the purchase of the house that shows that your husband bought it prior to your marriage.

Then your husband draws up a will showing that he is leaving you the house if something should happen to him.

And - you send (again) a copy of the house insurance with both of your names on it. Use a highlighter and highlight both names.

Include any mail that has BOTH of your names on it (I've been collecting wedding invitations and thank you notes!), and highlight both your names.

Perhaps they overlooked or lost the original insurance copies - but list EVERYTHING you are sending in your cover letter, so they know what to expect in your package.

Good luck.

Sukie, i appreciate your help, so far i already collected some evidence the recent ones like recent bank statements & the old ones such as the insurances that seems they didn't get it or look. We already called the Credit cards yesterday and my name already on them so i'll just wait until next month so there'll be statement with my name on it.

Then for property we are gonna put my name on one of the car but can't do to the other one because we've to do refinance, same with the mortgage. My husband called yesterday and can't put my name without refinance, and my husband already did it on last May.

So i'll write the letter for this to USCIS to explain that we won't be able to provide for home mortgage & i'll send the copy of the mortgage & refinance one.

Plus do you think i better sending them the most recent evidence such as utility bills, pictures, or some screenshot our conversation on Whatsapps & any junk mail with my name & address too? is it necessary?

Thank you

Spearmint, according to what you wrote earlier, it appears they are focusing on your living situation. So stick to evidence that shows that you live at the same house. Don't use catalogs or junk mail. Use official-looking mail like utility bills and credit card bills and bank statements. And...realize that you need to prove that you have lived together SINCE YOU GOT MARRIED. The latest utility bill isn't good enough. Show utility bills (like one per quarter) from the time you got married and started living together.

The burden on you is to prove that you have been a (continuing) couple since your marriage. It's about evidence over time - not at a certain point in time.

Forget the pictures and Whatsapps. Focus on your home together.

Will do then Sukie. about utility bills i already sent them since the first year until the recent one when i sent the package and on the RFE letter they don't mention about it. This are what they mentioned :

1. Child >>> We don't have any except our four legged dogs & cat :)

2. Mortgage / deeds / instrument >> We can't give the mortgage paperwork because already refinance & we'll explain abut the condition

3. Insurance >>> Eventhough i already sent some copies before and they don't mentioned that we submitted them ( they only mentioned we submitted tax, utility, bank statements, greetings card ) not mentioned for pictures or my 3 affidavit letters too

So we'll sending those insurance such as vehicles, health, home insurance & will write on the description letter that unfortunately at this time we don't have life insurance

4. Loan document >>> Can't provide the other car because have to do refinance but the other car there'll be my name on it for the title.

5. Rental / lease agreement >> We don't rent / lease but we'll sending our lease agreement with my name on it for the furniture eventhough is already done paid for it.

6. CC >>> We'll sending the cc statements with my name on it plus copies of the cards

7. ID card of us >>> We sent our driver license before so we'll sending again

What do you think ? Thank you

Do you know about the envelope with the address on it already & they attached with the letter? It won't fit for the paperwork, what is it for, weird :)
