Good morning everyone! I'm not complaining at all but I find it a little strange.

In came on the Visa waiver program last May (without any intention of getting married), but he proposed, we got married, and we filed for my AOS well aware of all the risks we were taking.

I got my NOA1 in July, and we also got a RFE (on i485). Today I checked my status on Uscis website and they scheduled an interview for November 3. I'm really surprised, we were ready to wait 9-12 months.. and it's not even 4 months that we applied. Is this normal? Could it be something else? Do they usually do more than one interview? Any similar experience?

DAY 12 07/23/2015: NOA1- case received

DAY 33 08/13/2015: RFE (on i-485) was mailed :(

DAY 40 08/20/2015: RFE Hardcopy received

DAY 44 08/24/2015: RFE response sent

DAY 66 09/15/2015: I-765 (Employment Authorization) approved

DAY 73 09/22/2015: EAD card received!!!!

DAY 112 11/03/2015: Interview day!

DAY 113 11/04/2015: Application APPROVED!

DAY 115 11/06/2015: Card was mailed to me.. :luv:

We knew it.

Time, distance,

nothing could separate us.

Hi,

I would say that you are lucky to have an interview after not even 4 months, it takes normally around 7-9 months. I filed in december and still have no green card... No interview for me though, I am considered as a Interview waiver (married for 4 years now).

However, I think that you will have to prove to the officer that you entered the US with no intentions to marry...as you may know, you can come to the US as a visitor and get married but... you normally have to go back to your country and wait for the application to get complete, interview at the US consulate of your country etc... USCIS may look very carefully at your case as it could appear to them as a visa fraud.

Be prepare to prove that you actually came to the US just for a visit, they can ask you if you quit your job prior to travel (if you had one) etc...

There is just 1 interview.

Like I said, maybe you are just very lucky to have an interview so soon!

But be prepare just in case you are a red flag for them.

I was mistaken about the normally 7-9 months waiting time, I was thinking about a K1 entry.

A CR1 (your case) takes normally more than 1 year to have an interview, the average is around 420 days.

I really had no idea that he was going to propose.. There are thousands of Skype conversation about it, I had a return flight, never quit my job before leaving, and also I was attending my second year of University.. I have documents showing that I paid the taxes for that year. I hope that's enough.

I'm not under the CR1 category since we got married here in the US. We were sure we were doing something legal since I had absolutely no intention of staying.. After he proposed I figured it was better just to stay together.

I'm literally freaking out. Just hope everything goes well. :unsure:

Hi Veronica,

Don't freak out!!!

That is almost certain that the officer will be a little bit suspicious at first (it's his job!!!), but if you have proofs (and it seems that you do) that you did not intent to stay, then you should be good.

I came in as a visa waiver married for 14 years. Ive waited 4 months to have my interview since May 2015. October 5th I had my AOS interview in SF and it went well. She didn't asked why I overstayed. The only questions she asked was when did u get married? What's my Hme address? What's your kids name? (I have 3 daughters with my husband) if I was married before? What was my last entry coming in USA? I said sept 2015, I travel out and came back in with advanced parole. She did not take my i94. She basically asked my husband (US Citizen) the same questions. she gave us a letter saying my case is being held for review. We will find out in 4 weeks or in 3 months. I wasn't nervous.

Just an update. I had my interview last week. They separated us and asked pretty simple questions like name, address, how we met, how's our apartment, what car we drive, how often we see his mom, what are our plans for the future. The officer didn't ask why I got married under the VWP, he didn't even ask if I had any intention to stay, he didn't look at our photo album and he wasn't interested in seeing further proofs of our bonafide marriage. Four hours later I got an email saying that my card was in production.. My I-130 application was approved the following day and according to my Uscis website case status, last Friday the card was mailed to me.

Seems like everything went for the best, I'm glad I can start planning my life again.. :)

Yay congrats. ??. I got approved and got my greencard 2 weeks after my interview. (Oct 22). Approved under VWP also????
