Good Evening to all members,

I want to know if my sons are eligible to apply for US Visa at this time. They enter US in 2010 as immigrants petitioned by my US citizen husband. Both of them have greencard since 2010.. They went back to Philippines in 2013 for vacation and stayed there for 5 months and 25 days to be exact. My question is, Can they apply for a US citizen now even if they left US for more than 5 months? They are ages 21 and 23 at this time. Its been 5 years already since they arrived here in US.. But i'm afraid their stay in Philippines for more than 5 months can affect their application for US citizenship. Please i need an advise. Thank you so very much!

An applicant is eligible to file if, immediately preceding the filing of the application, he or she:

  • ball.gif has been lawfully admitted for permanent residence (see preceding section);
    ball.gifhas resided continuously as a lawful permanent resident in the U.S. for at least 5 years prior to filing with no single absence from the United States of more than one year;
    ball.gif has been physically present in the United States for at least 30 months out of the previous five years (absences of more than six months but less than one year shall disrupt the applicant's continuity of residence unless the applicant can establish that he or she did not abandon his or her residence during such period) and has resided within a state or district for at least three months.

Thank you hei luoi for your reply. By the way, do you know how long can a dual citizen stay in Philippines? how many months or years are they allowed?

Yes they can apply they didnt break their residence here.

If they are dual citizens they can stay as long as they wish. There is no limit of how long they can stay out of the US like a permanent resident.
