Hey guys!! Wondering if anyone has any experience on renewing their L1 visas. My entry date on my L1-B visa was Nov 5 2014 and my I-94 expires this November 5th 2015. My company has sent in a new I-129 for a renewal on my L1-B Visa and it looks as though my processing time at the Vermont Office is behind by 3 months. I have received my receipt that USCIS has received my application and it is pending approval.

Do you know if I have to go back to Canada if I do not get my approval right away before my I-94 expiry? What I am being told is that as long as my application is pending I can stay until there is a definite answer, just if I leave the US for any reason after Nov 5 2015 they won't let me back in until there is a decision on my new visa application.

Thoughts?

Do you know if I have to go back to Canada if I do not get my approval right away before my I-94 expiry? No, you're allowed to stay while your application is pending. The date on your I-94 is irrelevant now that USCIS has acknowledged receipt of your renewal application.

What I am being told is that as long as my application is pending I can stay until there is a definite answer, just if I leave the US for any reason after Nov 5 2015 they won't let me back in until there is a decision on my new visa application. To enter the US you'll need a valid visa, not a valid I-94. If the visa in your passport is still valid, you can reenter, if not, you have to wait for the renewal.

F1H1I130 --- I am currently still in the USA working. I didn't plan to travel back to Canada until I receive either my renewal or my denial.

Then you're fine - you're authorized to stay until a decision is made on your petition.
