I just read in an NVC guide here that you should file married on your taxes.....My accountant was against that and I filed single, how likely is this to affect our visa petition?

i have ungodly amounts of proof of relationship, we lived together for several years in China, took somewhere around 56 flights together, years of photos with family and together of course, She has my last name, the list of proof goes on and on,,,, we just paid the IV bill, should i back up and amend my taxes again now? or just explain that i was advised against filing Married with a foreign spouse?

All my friends whose spouses have passed their interviews have been filing as single.

Did you file Married? I just talked to my accountant again and she told me without a SSN or ITIN it can be considered fraud to file married. Alot of conflicting information out there

you should file as Married Filing Separately...Consulate might ask for latest tax returns at the interview...Please amend it now.

you should enter 'NRA' in form 1040 when it asks for Spouse SSN

Follow the guidelines listed here (under 'Tax Information')

True you have to mail in. I been doing it like many of our friends in this immigration hell for 4 years. It's not a problem using Turbo tax you just can;t electronically file without a SS# in there. Doesn't mean you can;t file period.

And its not the best thing to do filing single when you are married. You could have the CO from hell. I know personally two people who did so. And was put in AP until they amended their 3 years worth of taxes. One it took over 6 months the other almost a year. It can happen and the CO is within their rights to request you fix now.

Married is married we are not single. Also goes against you trying to join things and co mingling of things when you won't even file taxes with their name on it. My husbands name is their on my tax forms no SS# and NRA is written instead. All according to the IRS guidelines and statutes.

I will be there at the interview, I just amended them all three years worth because of previous mistakes on foreign earned income, not gonna amend them again so soon if the question comes up i will answer it truthfully, didnt know you could file married without ssn or ITIN, My taxes are done by a professional accountant, single is the safest wat to file since you are gauranteed the highest taxes.......It is about 50/50 on this in all the places I have asked, most of the couples in my fil-am group have been filing single as well. Ill let you guys know what happens, AOS is already sent to nvc anyway.
