2014 W2s and 1040A okay for i-864?

Hi all,

I'm preparing to send off our AOS and I just realized that I don't have my 2014 tax transcript!!!! I requested one by mail, but it will take 5-10 business days and I'd like to send the package at the end of the week.

Will 2014 W2s and my 2014 1040A suffice? I am including tax transcripts from 2013 and 2012 also.

Please let me know your thoughts, THANKS!

Yes that works. I believe the instructions say "transcript or photocopy of your Federal Tax Return"

You're right! Thanks for reminding me I should read the instructions LOL. Here's the excerpt from the USCIS i-864 instructions that explains it:

"If you provide a photocopy of your Federal individual income tax returns, you must include a copy of each and every Form W-2 and Form 1099 that relates to your returns. Do not include copies of these forms if you provide an IRS transcript of your Federal individual income tax returns rather than a photocopy unless you filed a joint income tax return with your spouse and are qualifying using only your income"

If is is a complete tax return with all relevant schedules then yes it will do, all though I have seen some RFE's for tax transcripts come through lately.

Hi ..im confuse too my brother request a transcript and is 2 pages came is tht possible .so he request another cus mom told him it should be 3 pages..tht is holding up my package too..smh

You can't print it but you can call the IRS for the transcripts and they will send it within a week.

You can no longer print from the website. I waited on the phone for 2 hours today and still didn't get through. The first time around for the visa the IRS faxed me my transcripts so I was hoping to get them faxed again for 2014 tax year. I'll keep trying. In the meantime I did request them by mail - estimated delivery is 5-10 business days.

And yes, my federal tax returns include all schedules.

Financial documentation for Adjustment of Status is tougher than financial requirements for most consulates for visa interviews.

That's so great to hear tayjoc and congrats on your interview!

@Eb: I'll just have to take the chance here and rest assured that I've followed the exacty rules provided on the USCIS website on the instructions for form i-864.

I spent a good deal of time looking into this site last night at RFEs for i-864, and the majority of cases have more complicated financial circumstances than my own including joint sponsors with insufficent or unestablished incomes, periods within the past three years that one or more sponsors was unemployed or did not earn enough money to meet 125% of the poverty line for their household size, and various other particular situations. Not to mention, the folks who commented that they SWORE they sent the exact document that was being requested in the RFE. Sometimes docs get lost, sometimes we think we included them...who knows what happens when our applications are sent off. I can't account for these human errors in other peoples' situations, I can only quadruple (times infinity) check my own work, be sure to include everything that is required, and hope that nothing gets lost on the way to approval.

As opposed to the above mentioned cases, I am my husband's sole sponsor, earning under 100K (but well over 125% of the poverty line) which is why I filed the 1040A. I only derive income from my job, I do not own a business, I do not itemize my deductions, and I have no dependents or other special circumstances requiring me to complete any of the additional tax schedules. For the past 3 years my tax status has gone unchanged, so I feel I should be okay to follow the USCIS instructions to provide a photocopy of my 2014 federal tax return including all 2014 W2s, as evidence of my income. I have also used the option to provide tax transcripts for tax years 2012 and 2013, which I had requested for my fiance during his I-129F interview at the consulate. AND, just to prove my current income, I am providing a letter from my employer and a copy of each and every pay stub I received in 2015, including the one I received today, as proof my current employment and income.

I am hoping all of this will overcome any doubt that I meet the financial qualifications to be my husband's sole sponeor on the i-864.
