Timeline

Our interview was at newdelhi embassy .. I am nepali citizen

Yesterday after visa denial we were shocked and had no thought so just left

We are not giving up. Right now my wife is in embassy newdelhi seeking information and asking second interview

Congressman and friends are already sending emails to embassy.

We.wont go down without a fight. I was interview by a chienese lady in us embassy Delhi

She practically shut me down every time I tried to show her proof .. She didn't asked for aos even

In 5 min she said ur visa is denied

In letter says lack of evidence or to proove co or other legal reasons .. No idea

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal application send for EAD/AP : May 31,2016 (AOS pending over 1 year). Received June 2, 2016,Notice date June7, 2016, emails,texts, NOA1 hard copy

Service request for pending AOS April 21, 2016, case not assigned yet.
Service request for pending AOS June 14, 2016, tier 2 said performing background checks.
Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I'm really sorry to hear about this. I heard that the decision is already made even before the interview. Was that the reason the CO didn't even bother to look at your proofs? Keep fighting and I hope you will have a good outcome soon

I really feel for you, I hope you act in what ever way you can.,,.congressman, senator.,.,something I hope can be done!

You must be devastated.,.,, my heart goes out to you, it would have destroyed me, if it happened to me.

Have faith, and take what action you can, but sitting and waiting on USCIS for a year, would be my last option, but I know there is only so much you can do.

Today we were told that we were denied because we didn't had enough evidence of real relationship.

However we had.more than 200 pages of evidence I.e. finances together, multiple trips, photos, phone bills, mail, cards etc etc

They didn't even saw those during interview. Seems they were biased coz of age difference and me being nepali living in India

P.s we even sideloaded documents at nvc too.

We are not sure at this point what they wanted to have for evidence. God knows

I am glad she could talk to them. What are the next steps they suggested or you are planning?

Also is the age difference substantial? Did you mention that in your cover letter/story? I doubt that is the reason though. Is she Nepalese?, Indian? or other Nationality?

Was all this evidence what was in the initial I-130 package at USCIS? What did you submit from the beginning.

And your CO sounds like the dreaded "Dragon Lady" that use to rule over Lagos and deny everyone and anyone until she was reassigned to India about 3 years ago. Oh my. Man I remember those horrid threads. So sorry.

Acknowledgement of our marriage certificate from Boulder county

Affidavits from brother in law and friends in us.

Join title of condo

Beneficiary listed on retirement fund

Join bank account in Nepal

Copy of my wife's passport and visa to India and Nepal

Wedding.announcement from.news paper

Copies of tickets / trips

Photos -30/total photos

For nvc

We updated them with our phone bills, emails, joint bank account in america, info about our anniversary trip, listed as beneficiary for second retirement fund, copy of postal receipts of gifts and cards sent from benificary to petitioner and family

Then we brought updated bank statement, Skype , updated emails , more.photos from our trip but the co was not interested to look into it.

Well today they say lack evidence.. DOES THAT MEANS THEY WANT SEX TAPE coz that's all we can think more for evidence

Chasing embassy yet .. Not going down.. They can deny but can't rip our relationship apart.

Tomorrow they have open house for us citizen as well as we have appointments in morning.

All our family and friends are writing email and we have asked our congressman to contact embassy for us and request second interview

Whatever the consular thinks we don't care coz we love each other madly and visa was an option to live together.

They can't break us down.
