I'm on the same situation. I had a k-1 visa 2013 and me and my fiancé only live together 2 1/2 months. never marry and we split. I haven't send the k-1 package again but I'm very concern as well seeing that in my country there's a lot of fraud of this kind!

did any of you send a Waiver letter with the I-129f package?

Most Lawyer know just the basic really. I have seen here at VJ people getting approve with a similar situation as mine without a lawyer but

I'm sure having one wouldn't hurt. Best of luck on your interview as well. Lets all pray for an approval

So an update ?....interview is tonight for us and tommarow for him....and he hasn't recived his documents ....I'm nervous ....he will go empty handed ...just couple of receipts and some photograph of our relationship.....you guys have an expearnce on this..... Has this ever happens to anyone....

Also my lawyer spelled his name wrong on visa application and also wrote the wrong language .....I don't no how much of issue this might be.....

Well ...this is what happend. The documents that I sent him ...wasn't able to get him by the interview time ?

He went fully prepared regarding our relationship and my past. But he didn't have the original certificate and he didn't have the medical ..although he had the recite . And he didn't have my 1040s tax return

He went their and they asked these question,,...

What's your name what's ur fiances name ? How you two meet? Where does she live? How long have you known eachother? Did you know she was married? Did you know that her ex husband applied for a green card.?

And they asked him...are you gonna leave her after getting a free card....also how long after divorce your relationship with her began.. Which he said 6 months....

After all this ? he said your case is different ...Theirfor it's going to go under AP....and we will contact you when we make our decision. Until then don't go to the medical examination ...because it might take a while for u to here from us...and they handed him a yellow paper? stating he is not eligible for visa at the moment and on the bottom it says he needs to send the forms medical examination, tax return, and original certificate. So I'm confused ...are we denied ????????are we in the process of being denied... I'm not really sure...I been crying all day after hearing all this and also they gave his passport back. ???????so I know that's a red flag for when visas get denied.... ????? I don't really know what to do....I feel like even if we send all those documents he might get rejected either way....

This AP is 221(g), which is what he was going to get anyway for the short notice on the interview day. It's a denial, but really means "not yet". The refusal is the bad one meaning "NO!"

Maybe wait a week and get his medical done. He still may be contacted. He might still be approved. This situation isn't unique in the immigration world, but maybe for Afg. You are still in the process. Keep hope!!

Actually, one thing on the medical: it's valid for only six months. The visa will only be valid for six months after the medical is done. Maybe wait to get the medical and disregard my one week from now comment.

You two can overcome this!

Wait so ....I didn't understand... You think we should do the medical? ....btw what happens to ur fiances visa?

When I thought about it, I decided against my previous suggestion. Because if you get the medical in a few weeks and he doesn't get his visa until five months from now (may that not happen!), then you may have to get another medical done. But if they are ready to process and it's three or four months from now, you save yourself those months.

You also don't want to do the medical too soon because when you AOS, the medical is only good for a year. Sometimes the conditional GC can take 8 months to process, so a fresh medical is an advantage in the long run.

When you say he didn't have the original certificate, what certificate are you referring too?
