Hello, so my husbands conditional resident card is expiring in December and we have 90 days to file the I-751
I gathered all the required proof and we filled out the form and mailed everything out and really thought we were good!
We weren't missing a single thing.

Just today we got mail from the USCIS, they returned all of our documents, the check, and the original envelope we sent everything in
with this letter.

I'm so confused as to what this means. It looks like they are saying to submit the I-751 form AGAIN? I'm not understanding, that is what we sent with all the proof. It's so stressful, we sent all the required docs so what's going on? please someone help. I don't know where to go from here

When in December does it expire? Did you send it in before the 90 days?

My sons AOS and IV bill paid March 23rd (status in progress)
My sons AOS and IV bill shows as paid March 26
My IV bill paid March 26
Both packages sent on March 26
My IV bill shows as paid on March 27th
CC on both cases March 30


Current record holder of fastest through the NVC :D

Medical exam in Stockholm April 13th
Interview on May 16th !!!

POE Anchorage July 12th!! 2012

July 2015 n-400 in the mail

September 2015, interview

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Guarantee they got it before the 90 day mark.

Edited......look at the second paragraph it says that exactly. They got it before 90 days....you can't send it in before 90 days......it tells you exactly the reason for the return on the notice.

I don't understand, they don't accept it before 90 days? It doesn't mention that in the letter.

It's in the instructions, it's all over this forum, and yes the second paragraph says they received before the 90 day expiration of the green card. You cannot send it end before the 90 day mark, Whatever day it expires subtract ninety if it expires dec 28 subtract 90 day and you cannot send it in one day earlier than that. You sent it in a whole month earlier than that.

You can only file for ROC within the 90 day window before the green card expires. Your rejection letter clearly states you filed too soon, as it was not within the 90 days prior to the card expiring. They would not accept it prior to 09/29/2015. Enter the expiration date in top box and then it will tell you your earliest filing date > http://www.uscis.gov/sites/default/files/dateCalculator.html

From the I-751 instructions>

When Should I File Form I-751?

1. Filing jointly. If you are filing this petition jointly with your spouse, you must file it during the 90 day period

immediately before your conditional residence expires.

Refile it.

Ohh! I was a little confused by each paragraph and even read them several times before posting here, maybe I'm a bit on the slow side lol.

Thank you so much for clearing that up for me!

I can't believe the problem is that I sent it EARLIER than the deadline...that is so strange. I was worried I waited too long and it would be late, I mean wouldn't they rather receive the paperwork earlier than later? any who, thanks again to all who replied! I really appreciate it :) good luck on your visa journeys

Maybe that's why you are confused. The 90 day is not a deadline you don't have to send it in at 90 days......

It's like when you turn 21 you can now drink, you don't have to but now you can......

Yes you can't send it earlier :) Send it any day after today (9/29/15) and you should be good :D
