05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Of course your friend can't get a US green card because he was mugged on the street... The U visas are for real victims of serious crimes, such as human trafficking and slavery.

It says on USCIS' website that "U nonimmigrant staus provides immigration protection to crime victims who have suffered substantial mental or physical abuse as a result of crime. While being mugged can be a scary experience, it is nothing compared to victims of e.g. human trafficking and the U visa is there to help them find their way to some kind of normal life, while assisting police in getting the traffickers behind bars. If your friend wants to find a legal way to stay in the US there are other ways, e.g. work visa, spousal visa, student visa etc.

On a personal note, I wish people would think more about the consequences their actions have on other people. By putting in applications for a U visa because you've been mugged on the street or any other "petty" crime, it means that USCIS have to spend time dealing with those ridiculous applications, which takes time away from the real victims that do need and deserve the U visa.

Hello

Well one of my friend got robbed his phone and money by a thief with a gun, also the thief told him that he would kill my friend if he got the police.

Someone told me that if my friend goes to the police he can also ask for a kinda special green card but we find that kinda ahrd to believe.. my friend didnt go to the police because his visa is expired for like a month and he is scare about getting deported.

does anyone knows about it?

involve a community leader to take him to the police just to be on a safer side.

wouldn't the U Visa be used in the case of relationship abuse not if you get rob at gun point. Couldn't your friend have asked for an extension on the visa that expired one month ago? In this case maybe he should consult an lawyer for the best options. Good Luck!

Good Morning Charles! I've read that i can see the Domestic Violence in this but that would have to be family, husband or wife but to be robbed at gun point. How could that be possible to apply for an U visa?

You could have a gang that is running about doing armed robbery and the courts want you to testify. You have to have value to the prosecution of the case not just have been robbed.

This will not be over quickly. You will not enjoy this.

While some of the crimes allegedly committed may fall into the U categories, I would think this visa is really only used to give or extend an alien's temporary legal status while aiding law enforcement to convict a big fish. I highly doubt they would offer it in the case of a mugging. Otherwise you'd have people staging muggings left and right.

There has been an awful lot of ####### posted on this thread and I am very surprised a Mod who has participated has not been deleting posts furiously.

I posted the rules, I have seen many U Visa cases, I see no reason why this situation could not result in a U visa. Certainly here there is no decnet guidance, plenty of places out there that do, Seems likely the person is in CA and that is a particularly supportive area.

Couldn't agree more. It isn't a simple "mugging", it is an armed robbery. If the police are cooperative in issuing the predicate paperwork, then, on its face, it seems like a reasonable U-visa application.

It does exist the U visa for victims of a crime, having a phone and money stolen is not a sufficient reason to have the U visa granted at all. The victim should suffer substantial physical injury or mental anguish,the person has to file a police report, help the police or the prosecutor and then get a U VISA CERTIFICATION to submit along with U visa stating the victim collaborated with the police or prosecutor.
