Hi there,

my I-130 for both parents just go approved and I am waiting to hear from NVC.

I had to file separate I-130 for each parent and I would have to pay all the fees separately. Their case number is just one number apart.

If I continue the process and do all the documents and pay all the fees at the same time:

(1) would they get the interview the same day/time with the same officer since they are married?

(2) Can one parent be refused the visa and the one is approved?

If they both get visas, I would like my mom to come a few months (4-5) before my dad, because my dad will need to take care of some stuffs before he comes here:

(3) is that possible if they get the visa at the same time? I hear that visa is valid for 6 months.

(4) or should I delay my father NVC processing (by paying and submitting documents later) to make sure he get a later interview?

(5) If he gets a later interview at a different date than my mom, can the officer doing the interview hold that against them (especially my mom since she will going without her husband first)?

Sorry, too many questions, any answer you can provide will be extremely helpful!

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

No offense but timing this is always going to be an issue / concern. If your dad has the constraints to close out loose ends. The only issues seems you 'want' your mom to come earlier? Wouldnt the simplest solution be to just have them come together when your dad was ready and save everyone the concerns?

There are.

Certainly one parent can be refused and the other approved.

They have 6 months to enter so one could come straight away and the other a few months later.

If you really have to pay for both separately, ( i'd look into saving that money), but you can apply them separately if you are paying separately. They don't have to come together, and stay together etc. They are both your parents, they don't have to explain why they are choosing to live separately for 6 months. It's their decision, if IO asks, then just tell them the true answer that he was winding up things back home. If you chose to apply them together and he arrives then he might not be able to go back before his green card arrives ( not sure on this but seems the right thing to do), And i don't know how long will they send the green card, USCIS is always unpredictable with delays, I am still waiting for my renewal.

If you really have to pay for both separately, ( i'd look into saving that money), but you can apply them separately if you are paying separately. They don't have to come together, and stay together etc. They are both your parents, they don't have to explain why they are choosing to live separately for 6 months. You are right, it says separate I-130 for each relative. So yes you can delay your dad, seems like the best option. I am guessing you and your wife's combined income is way over level of poverty. I mean you have enough income to support them both. Also i can't stress enough the importance of finding an insurance for your parents and nothing under 500k or 1m. I recently had a visiting parent have brain hemorrhage and bills are about 300k. Good luck.
