Hello,



I am about to send application to remove conditions. I have a question about the tax documents: does it have to be the transcripts from the IRS? I thought it was supposed to be full tax return (at least, that's what it says on page 3 of the instructions for form I-751).



Also, should the applicant send only joint tax return, or he can send "married separately" tax return as well to remove the conditions? if the applicant sends "married filing separately" tax return, should his/her spouse also send her "married filling separately" tax return too in the same package of documents?

I'm in the similar situation. We both filed married filing seperately, so I'm sending the IRS transcripts of both me and my wife. Since I'm the one removing conditions and i don't have tax receipts from 2013, i'm sending mine for 2014 and my wife's receipts for 2013 and 2014.

I don't think it matters if you file(d) your taxes jointly or separately as long as you filed "married." My guess is that USCIS would want to see both transcripts if you filed married--separate.

I don't think you need a lawyer.

If your situation is geniuine and you have enough documents. You can file by yourself (with spouse).

I'm filing next week.

No, I don't think you need a lawyer. The I-751 is pretty straightforward. Read the guides and gather the evidence listed and you should be fine. Good luck.

Everybody,

thanks again for your attention.

Another question: I received my tax transcripts from IRS for 2013, 2014 (married filing separately). For some reason, we still haven't received the transcripts of my wife. In my transcripts it indicates "married filing separately", as well as my and my wife's SSNs. Shall I send my transcripts for 2013 and 2014 or I shouldn't? I have already waited too long for my wife transcripts from IRS and I want to submit the application to USCIS.
