I think you are confusing marriage license with a marriage certificate. license is something you get prior to getting married and certificate is what you get once you are married.if i got your query right, you mean you had applied for a marriage license while visiting US and got married in the US on a different visit or may be the same visit. i would suggest you to relax. this is very minor and as you just change your personal marriage plans.you should not be worried.you are just taking advantage of this loop hole by not going through longer K1 process but by adjusting status while in US. this is legal.

We got the license from a previous visit as we were planning to do K1 when we got back (we thought the license would of been a good proof to use that we had every intention to get married after entering USA on K1) but we decided to go for another visit and collect more proof of a real relationship and was going to file for K1 when going back after this visit but instead got married.

So you dont think they will look into when we got our license?

Also i think this helps with our intent, we first booked to stay three weeks then prolonged it to 1½ month and then we got married after the second month. Will they not look into that. And also, I get very confused by you guys, one of you said the thing with the marriage license shouldnt matter and the other one told us to seek legal advise.

my answers are not that of USCIS, i do not think this will be any problem at all. you are freaking out for something that is not serious,like someone else said ,hire a lawyer. make sure , lawyers can't guarantee anything, a lot people here on this forum know quite a bit. the law is redundant .

good point unchained. they do expire. do not remember the validity they come with though

No, the office said its valid forever and it worked for us to get married on, we filed for it about 5 months before getting married, we only stayed in Iceland for about two months before going back to the US again.

They just told me marriage licenses do not expire in this county, so I guess that means USCIS definitely will check when we filed for it. I dont even know, do they keep the dates in the register for when it was filed or maybe (wishful thinking) it only says we had a valid marriage license (since the date not being important due to it being valid forever)?

In the last post OP mentioned two children of 7 and 8. I'm not sure who would take two young children on holiday and then decide to stay on a whim. What about their schooling?

With the business of adjusting from VWP, the dates on the marriage licence and marriage certificate and the issue of the missing father, I definitely think this is not a DIY case.

We only have the marriage certificate, we sent the license in after we got married..

Were you issued a marriage license here in Texas and married here? If so, a marriage license is only valid for 30 days from the date it was issued.

I am a USC born and raised here in San Antonio, Texas (Bexar County)... If you go to the Bexar County Marriage License website, it states that marriages that take place after the 90th day from the license issue date are not valid as the certificate would be expired. If there is some sort of way that law doesn't apply to you, I have no idea what it would be.

*Correction to my earlier post, I typed 30, but meant 90.
