Affidavit of support I-864 questions

Dear Members,

I need help in Affidavit of support Form filing.

My wife is the petitioner. She lives with me in Saudi Arabia. She have never done a job in States so her form I 864 will be filled with Zero income and her Father will be the joint sponser

My questions are as follows.

1. What form her father should file I-864 or I-864A

2. Her Father (My father in law) files the tax return together along with his wife (my Mother in law). So the receipts of IRS will have both names. Should her mother also file Affidavit of support. if yes, then should it be I - 864 A

3. My wife's and her parents mailing address is the same.

Please clarify.

I864 for your wife I864 for her dad and I864a for her mom. Letter why she doesn't have to file tax.

Thanks for your kind reply.

Just one more question regarding the letter from my wife. Is it sufficient to mention in the letter that she is not working and is dependent to her parents. Because she is mentioned as dependent in the IRS receipts?


I cannot find I-864 A form. Can you help me with the link please

Not working in the US is not a reason to not file taxes. The US taxes on worldwide income. If your spouse has earned below the amount required to file a tax return then she would submit a signed statement along with her I-864 saying such.

Being claimed as a dependent does not exclude you from filing. If her parents claimed her as a dependent on their most recent tax return then your spouse will also be included in their family count. Just follow the form I-864 instructions.

I just want to calrify one thing that my wife is not working at all even outside US. So what will be in that case.
