I-601questions regarding new application

Hi,

I recently had my immigration lawyer put together my whole I-601 and packet. I am waiting for a decision. I was denied at my interview because the consular officer wanted a joint sponsor as my wife apparently didn't make enough. (She just cleared the minimum but he wants a joint sponsor anyhow.) If we can't find one, we will have to start the ENTIRE process over in January, as this year she earned about 10k more than last year, and the joint sponsor should not be necessary. SO...IF my waiver is approved, do I have to apply for another one next year when we start this entire process over again? Also, if my Visa application is withdrawn completely, can I use the waiver to visit, or do I have to apply for a different waiver used only for visiting?

I'm confused..you had your visa interview and they told you that you need a waiver? Or did you file the waiver and are waiting for the decision? Gather the :-Osponsor infO. If you are waiting for the waiver decision, you can submit the co-Sponsor info when the waiver is approved and sent to the consulate.

The consular officer at my interview, said I need a joint sponsor and a waiver. I applied for the waiver. My question is, if I can't find a sponsor, and we withdraw the application until next year, do I have to apply for another waiver, or will this one be good?

Don't withdrawal. I believe you have a year. Or just submit a new AOS immediately after she files her taxes in 4 months. Contact them and let them know you plan on submitting a new AOS.

I emailed them a few times asking for a review of my wife's tax returns, as she made over the minimum required to sponsor, but they replied back saying that they still wanted a joint sponsor. We had one family member in the U.S offer, but she didn't quite make enough. If I email them again telling them what you suggested, I'm afraid the same consular officer is just going to be firm that a joint sponsor is still required, even though my wife made 9-10k more this year than last year.

No, only me. She is a U.S citizen, residing in the U.S.

Dir her last years income meet the guideline? I see on another post you said she was short $1250. What is your family size? You don;t have country so can't speak to the embassy you are going through. But many embassies want to see current and previous above the guideline.

Actually she exceed it by $1250. (Maybe I worded it wrong on the other post.) She also meets the minimum for the 2 years previous to that as well.

If I were you....I would ask them if they would consider holding off and let your wife submit 2015 tax transcripts. I hate when then get nit-picky

This is exactly what we are going to do. I have until May, (the one year from the interview), so it will be in time for sure. Thanks for all your help, btw!

Current income is what counts not tax transcripts.

The CO didn't ask for her current income, he wanted to see what she made in 2014, so that's what I showed him. Besides, she had current paystubs submitted with the I-864.

Dont withraw the waiver, it could take mths for approval, the I 184 can be sorted out meanwhile
