Hello all

I have searched a lot on k2 visas here and elsewhere and can't seem to find the kind of information I need -- maybe some solid advice is really all I'm looking for.

I have filed for my fiance (philippines) to come over and we have received NOA1 early this month. I included her 4-year-old daughter in the I-129f. My fiance does not want to bring her daughter right away for understandable reasons -- starting a new life in a new country is intimidating and as sure as we are about each other, it is a big step to trust someone with your child. I also have a daughter and completely understand this sentiment, I would be most apprehensive about moving to a new country with my daughter. So we decided to have her daughter come after we have been together for a little. Initially we wanted to do a to-follow k2 visa. But fiance does not think that anyone else will be able to help her daughter -- take her to the medical appointment and take her to the interview. It would certainly be easiest if we can process the k1 and the k2 at the same time. So:

If we process the k2 at the same time as the k1 -- will the visas both be issued the same day with a validity of 6 months? So if my fiance waits 2 weeks to use her visa, the clock is already ticking on the k2 visa as well?

Is the k2 visa always issued with the same 6 month window as the k1 visa? Is there any way to process a delayed visa issuance for the k2 at the same time as the k1?

If we get the k1 and the k2 at the same time and don't use the k2 within the 6 months, can we still apply for a to-follow k2 even if the first one was allowed to expire? If we do this, will the entire process need to be repeated (as far as going to the medical and the embassy interview)?

Like I said I did search and read a lot of posts but can't seem to find the ideal answer to these questions. If this were you, what would you do in this situation? Any links to further reading also very much appreciated.

I am not sure I agree with your premise, I do agree it does seem common in PI to leave children behin, I have never seen it happen from the UK. different cultures I guess.

The phrase you are looking for is K2 follow to join, basically you have a year after the K1 is issue to do the K2. If you ne longer then you can petition as the step arent a year before, assuming we are talking about a minor.

Do you know if the follow to join can be processed at the same time as the k1? will anything issued at the same time as the k1 be for the same exact dates? is there any follow to join guide on this site?

Well if no one can take her to the doctor and interview then he is going to be with her on the plane to USA? Your wife won't be able to leave USA for awhile after she comes??

She will be able to go get her and bring her to the US, but it's not really a financial possibility for me to buy her a plane ticket to take her daughter to the appt and embassy before hand too -- we're just two young lovesick working class folks :)

Sorry I should have clarified -- she is in Cebu and the embassy/medical is in Manila. My fiance just doesn't think another person will be as willing/able to fly to manila with her daughter, stay in a hotel, take her to the medical, wait around for a few days, take her to the embassy, then come back. It's not that it wouldn't work out -- just leaving it to another person is a lot to ask of someone and a lot to trust someone else to not mess up!

How about the someone who has 24/7 custody of the child?

Either her sister or her aunt will watch the daughter for the time... sister is super nice but not very reliable and Auntie is super nice and her family never allows her to do much because the rely on her for everything!

It might be possible for them to help with the visa but jan doesn't want to impose and I'm trying to find out exactly what the timeline is with the k-2 options. It may be that we can ask her relatives to help but I want to make sure we have chosen the best option.

I think the best choice is to have them process together and come back to get her daughter later. But I want to know if their dates will be the same or if we can get an extended date for her daughter somehow with them processing together. It would be nice to have a tad over the 6 months or at least the option to delay a little if needed. Also I am curious if we process together and get delayed so the k2 would expire can we still process a to follow visa.
