Petitioner withdraw the petition of stepdaughter

So I been having problem in my marriage due to my husband cheating. My daughter interview was September 4 at the embassy my husband withdraw her petition due to his controlling, spiteful and abusive way.. I am a LPR what can I do? I can provide evidence of his cheating....

You can now petition your daughter yourself. You can't force someone to petition someone. His cheating will only prove that you'll don't have a legit marriage. Therefore the basis of his petition for his stepchild is now false.

Our marriage is legit.... We have a son together and I'm currently pregnant with his second child.... Was just wondering if there is away i could substitute myself has the petitioner....

Didn't you just said you wanted to report him for cheating? Than that says a marriage is in trouble. Having children between a man and woman only proves that thy had sex together.

You can't take over his petition, once he has withdrawn his consent it is dead. You will have to start over from the begining.

Again my statements are only based on your words.

Only you and your husband knows what your position is in your marriage and that's the way it should stay. But, my advise would be maybe checking to ensure that he has really withdrew the petition because, maybe that is him just running his mouth if he is the controlling person as you have stated. Okay first if she had a interview September 4th that means she either Got approved or No. What exactly did he stop the Visa? Have you go to

ceac.gov and verified the status of the Visa (Should say issued by now). You need to check things out now.

After checking out the status and still not sure email the embassy and just ask "when can I pick up my daughters Visa/Passport"). I pray you been in the loop all this while and have her case# and IIN so you can log on and find out things.

Can I ask did you talk to your daughter? I am just assuming she is old enough to tell you if she was approved or not.

USCIS with the active I 130, you will need a cosponsor...phone NVC...You must

now decide can your daughter co exists in a home with a petitioner who renege at the

embassy stage...Such a slap in the face having PP return with that letter. Petition your own kid

My daughter is only 9 years old.... If I file the I-130 where do the cosponsor comes in.

When your approved petition goes to NVC if you don;t meet the poverty guidelines (Are you working) you would need to make enough for your household size or you will need to get a co-sponsor.

But the petition is withdrawn dead so you will have to start all over pay $420 to file and all that.

So sad you just been married for a year. Sorry

Wow, that is rough. So sorry to hear what you're going through. :( You're married to an abuser. Sounds to me like he messed up with the cheating and now he's gonna try and keep you by using your daughter and the petition as leverage. Or maybe this was his plan all along, since he didn't petition for your daughter at the same time as he petitioned for you?!

As others have said, you can petition for your daughter on your own. You need to start over with the process from scratch and go through all the steps again, this time with you as the petitioner.

Oh! WOW! this is so sad to know that your child could have soon been with you. Please contact the USCIS and maybe they can guide you on what steps to take. I will pray for you all because to be pregnant and then this added stress is not good. Take care and the best of luck.
