I-130 approved as F2A, upgrade IR @ NVC

I was LPR when I filed for my daughter (16 years old) under F2A, petition was approved and PD is November 2014. In April 2015, we received letter from NVC in our country, we have a case number. Contents of letter is that visa number is unavailable and the petition is not eligible for further processing at that time.

In August 2015, I became US citizen. I mailed to NVC requesting to upgrade my case. I tried calling NVC numerous times, and I cannot get on hold to speak to someone. So I called USCIS, explained my situation and the agent told me that my daughter (17 years old now) is eligible for I-485 (AOS). I just notice that the fees for AOS is payable to US Department of Homeland Security.

Is your daughter in the US?? If she is then you can file for an AOS by completing an I-485.

But, it looks like you can just continue processing at NVC since you say the AOS fees are available now. It's also not really necessary to upgrade the case now since the processing has already started. But, if you want, you can send NVC an e-mail with supporting documents requesting they upgrade her case (although this may delay it).

Write a letter to NVC asking to upgrade your petition because your a citizen now. When you submit your letter asking them for upgrade include the copy of your naturalization certificate.

If you would like to talk to them try calling as early as you can like 7am sothat you can get hold on them because if you try to call after 8 or onwards the chance of talking to them is like 10% because there line is always busy assisting other customer.

Here are some updates.

8/30 - mailed NVC upgrade status and intention to file AOS with USCIS

9/30 - filed AR change of address online

10/5 - received emailed from USCIS acknowledged our change of address.

10/9 - I-485 Adjust of Status packet mailed.

10/17 - Case accepted and routed to USCIS National Benefits Center.

10/19 - Check cleared.
