withdrawal of affidavit of support

i marry this guy overseas, i paid for him everything i want to know if i can withdraw the affidavit, because he proved be a fake husband that the only wants the status through me, that he has other relationship overseas while i was sending money , to who i thought was my husband, and finally when he came here if find out that he has a child with that woman, he came here i went to pick him up, only for me 9 months later in between find out , he got the card, he was saving money, and he left me , so the affidavit of support is useless ,he never acted as a husband, nor care about me, no sharing bank accounts nothing, not even a picture of us together here, my kids saw him the way that he was behaving, of course i find out his betrayal,so why if i dont earn a lot of money he is living here in miami do not know where i was in a course of annulment of divorce from him because he even did not want divorce from me either, so some one can know if that can be done? i sent messages to lawyers still waiting for an answer,..

Once the green card is issued the affidavit of support cannot be withdrawn.

If you have proof of fraud you need to report it.

Does he have the two year conditional green card or the 10 year card?

he waited 2 years overseas , they never gave him the conditional, he started to live with me when i pick him up in july 2014, and he left me 4 months ago, and yes i sent to immigration the proof, he have the 10 years, immigration did not interview me with him, when he arrives, he never proof that he married me for love, not for the status, i proof what my feelings were true, in my part was a bona fide marriage,..

i am single mom with 4 kids, and this guy coned me, betrayed, lied, and he did everything so carefully so i did not find out that he has someone else, i spend love , time, money, and he came here and later laugh at in my face. i sent immigration everything, he did not acted as a loving husband, obliviously, because his goal, was the status, i and then he lef, like nothing happen, i will move on to immigration, i will not pay bills for someone that even dont live with me, nor love me, or even consummate this marriage, thank you for your answers have a good day.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I'm going to ask a clarifying question on behalf of jb1974. Are you who posted saying that she is responsible to support him no matter what or that she has no recourse in changing his status or both. I know the status thing is a done deal but are there cases of the government pursuing individuals filing for public assistance? Wouldn't she be better off cutting his funds and letting it get sorted out by the courts?..as I type I'm thinking this may more be a question of divorce and not immigration. Sorry jb. Good luck try to let this, learn what you can, and move on for your own sanity.

No recourse for both. It's rare that they will sue but it's possible.

If a person marrys for just a visa and entered the US under false pretense, why isn't it fraud? He committed fraud agaoinst the US government. To me that is a federal violation. Just wondering how some get away with this. Green card or no green card. He did this wanting a visa only and he committed fraud. He should be proscuted and sent to a federal prison and then deported. If the applicant can prove he committed fraud and she didn't, why not is he allowed to stay?

When this happens the US person can submit all the evidence they have to the fraud unit of USCIS. Then it becomes a choice of the government of if the pursue any action against the immigrant. There is no I didn't get what I bargained for take them back unit. No one should petition someone they don't know extremely well. Meeting online is a terrible way to find a spouse unless you spend months getting to know each other face to face before letting your hormones drive you into marriage and bed.

This will not be over quickly. You will not enjoy this.

How much time did you spend with him in a single trip ? People should spend at least month straight with someone they are thinking about petitioning . Actors can only play the role for so long. Hidden spouses can only stay hidden so long.
