i-864 error after sent package....

Dang it...

I already sent in the AOS and IV packets.

On her I-864s my joint sponsor, who is married and filed jointly, listed her *individual* income from her W2's instead of her and her husband's combined income from the 1040s. Is this a mistake??

What can I do? Should I send the corrected forms to NVC asap?

If you are only using her income, and she meets the poverty guidelines with her income alone, it seems like you shouldn't have a problem. As long as you sent in either the complete tax return or transcripts (W2's are needed even if sending transcripts when your co sponsor has filed a joint return) I think it would be okay. I'm not 100%, so I'm sure someone else can either correct or confirm that info. :)

The best information I had gotten was if only one of the joint filers are sponsoring, you would put only their income on the I-864 as that is what would match her W2's from her employment. Hope that makes sense :) Good Luck!

It was Saylin's NVC wiki that brought this to my attention... She states that joint sponsors who filed jointly should put the joint income and that its a common error

Sorry for the confusion, your case is a bit different to mine as my joint sponsor is married, files joint, but his spouse has zero income so all the totals on mine were only reflecting his income! Let me direct you here, this looks like this is what may help you :)

I just talked to NVC and they said that my joint sponsor MUST include her spouse's income and that he MUST fill a form i-864a... and that their combined income should be listed on each i-864/i-864a

VJ forums have conflicting information :(

That is very conflicting as I have read several times that it wasn't necessary if our joint sponsor met the requirements alone. Plus, we didnt send his wife's 864A, and didn't get RFE'd for that. We forgot to send in his W2.

I got the SAME operator. I read the I-864 instructions to her and so this time she put me on hold to ask someone... Now she says that my sponsor's husband does not need to fill an i-864a and she needs to only put her income on her I-864...
