Back in April 2015 I petitioned to have my husband come to the US. He is a Canadian citizen. I submitted the I-130 in April and received a receipt of acceptance I-797c Notice of Action form. The acceptance date is 4/24/15

Our paperwork went to Texas and I was told that it was an average of 5 month. The current updated site says they are processing I-130 applications from Feb 2015.

In reading these forums it seems that people are getting everything done much sooner and are living together in the States. What am I doing wrong? He lives in Canada and I live in Arizona. I go there often but they I hear how not only are people living together as husband and wife but are able to work here in the States while they are waiting for there status?

Please let me know what I am doing wrong.

We started January 30/ 2014 Interview at MTL consulate was May 21/ 2015 the case is under administrative processing since then... Waiting and taking one day at a time. Be patience :-)

Cold hands I really dont even know what those links mean. I went to the http://www.uscis.gov/site and that is where I found what is currently being processed at the office our paperwork went.

I was going to try and add a photo of it showing they are currently working on Feb 20 2015 but I don't know how to add a picture here.

As stated in the page header, those are times based on direct feedback from VJ members timelines. so ppl like IDY and others whome update their times can help render the data trend/stats for everyone to know vs posts such as this when people are worried about being off track. You can see the differences from diff countries and Service Centers. VJ has a lot of rich data / info already baked in.

Hi Zuzie:

After USCIS they will send the case to NVC (national visa center) and they will ask for more info and pay some fees, just make sure you mark everything correct, I forgot to mark an (x) at the affidavit of support form and I had to resend it and wait for another 76 days for them to review it. When they finish they will send the case to the consulate and they will send you notice with your appointment date

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

It's a slow and quite often frustrating process, my wife and I thought the process would be 6 months at the most

Being a Brit and the special relationship USA/UK have.......

An no!

Filed in July 2014, visa approved sept 2015

We had a couple of hiccups on the way, lost paperwork,lack of comms etc

But it will happen, keep being positive

Regarding other people that are with their spouses, many got married while their spouse was in the US and simply adjust status. My wife, for example, was in the states for 10 years from high school through graduate school during which time we married. We would have simply adjusted status (I met her many years into her studies, so she had no intent to immigrate) but also had a J-visa originally which required a 2-year homestay before immigration is even possible. As a result, she had to return home after graduation for a little over 6 months. Luckily she took care of most of her 2-year requirement on vacations over the decade, but we had to go CR-1 to get her back.

The CR-1 was just a long and stressful process. Our petition got lost at one point, was sent to the wrong USCIS offices by USCIS once, and both times they pull that "we won't tell you anything for 90 business days" excuse. We managed to get an expedite at the NVC on the grounds of USCIS screwing up so much, and with out that it would have easily been a few more months.

Just make sure you keep track of everything you are doing, track your documentation, and most of all just be patient and have some humility. Sometimes its hard to look past the fact that you are in love and you deserve to be together and just go along with the tide.

The good thing is the CR-1 is a nice visa. She had no issues at her point of entry, no issues getting her greencard, working, etc. We're just now in the removal of conditions phase to get her IR-1 (which again is more money, stress, and waiting).

Wow I wished I had found this site sooner because I don't feel so alone doing all this now. My friends and family are always asking me ... whats the status? I say you can't help who you fall in love with ...

We met in 2012, long distance dated (hated that) He was able to come to the stated for 5 months until once on a return trip he was stopped at the border and they refused him entry saying they suspected him of trying to immigrate illegally. He said No. actually I am trying ti immigrate legally. No go. He has only been allowed to come back when I had surgery. They even wrote on his passport that he could not marry while in the states. So last year I went to Canada and we Married at his family's home. Wh just had our anniversary on Sept 7th. He works in Canada, I work here in Arizona, and I travel to Canada .. a lot.

So we wait.. but you all have made that wait seem easier. Thank you all so much

FYI, passport notes like no aos or marriage don't hold legal weight. I know it doesn't help but it is what it is...or isn't in this case

Hi Zuzie,

I am a Canadian citizen and my fiance is American, so we are in a similar situation. We also started dating in 2012, and applied for our K-1 visa back in October 2014. Our visa was initially accepted in November, and like you I was hoping the situation would be a smooth and quick one (so many postings seem to make it sound like such an easy and quick process). The time period from the initial acceptance to the time you receive your letter from the consulate to schedule your interview takes the longest time unfortunately (we're talking +6 months!). I just attended my interview in Montreal this past Monday, making it 11 months since we originally filed. Now I am trying to patiently wait for my visa to be delivered where I can pick it up.

Mind you, everyone's story is different, but it can (and will) feel like a grueling process! My best piece of advice I can give you is keep organized, and make sure you keep EVERY piece of paperwork handy. One thing I found that was especially frustrating (and I tell you this because we are in the same situation) was conflicting info on the consulate website, and what is posted in the letter your receive from the consulate.

Mrs_xsnsn327, Wow I am excited for you both. Yes the being patient while waiting is very frustrating. I think the longer I wait that something is wrong and that there was something that I missed. But checking and double checking everything ... they have everything. I hope your journey comes to an end soon with USCIS .
