Okay, thanks. My work said they couldn't give me the P45 until after I'd left as I asked that myself.

I've ticked that I will be working full-time outside the UK on the first page. It's the page that says 'Income from the UK' and then it asks you whether you will be getting any income from the UK after you leave (I'm ticking 'no' although I did get my last wage payment form my work after I'd left for the USA but that was for work conducted when still in the UK) and then it asks 'Will you be working when you leave the UK?'. Click 'yes' and it opens up a whole load of options to give the address of your foreign employer, and you can't leave it blank as it won't let you move on?

I'd given up on this until today as I've been thinking about US taxes so thought I might as well get this sorted too! Can anyone answer my question I quoted above. It's all okay ticking that you will be working full time abroad but without any employer until EAD, I have no idea what to put in the boxes asking for information about an US employer when I haven't got one!

Can you put in "unknown" or "seeking employment" to make it move on?

My husband did a paper form that was mailed in, so no help from him.

Yeah, I tried that but it wants an address, date you started employment etc. I reckon I'm going to have to Skype call HMRC to try and get some more help. I tried once before and the person wasn't much help so I'm not optimistic.

What's confusing is that it is under a section saying 'income from the UK' but then asks whether I am working when I leave the UK and then whether the employer is a UK address or not? The only thing I can think of is that this section is catering for people who may be living abroad but still working for British company/still getting their wages paid into a Uk bank account? Maybe? I'm probably over thinking it but just want to get it right! The 'help' notes are not much help at all on the HMRC website.

Husband says in answer to your former question: select NO because you will not be working outside the UK until you are authorized. Since you CANNOT work, do not tick yes. If any questions do not apply do not answer them. He suggests you start over and make sure NO is checked. If you are leaving immediately to work (work visa) or to a company that is in the US or based in the UK then you select yes. The purpose of the form is to determine what tax is owed back to you, if you will still continue to owe tax, and to inform HMRC you are leaving the country.

Thanks for that. This is the confusing thing to me as others have said tick 'yes' because the time between leaving the UK and getting the EAD will only count as a period between jobs as opposed to not working.

What's the rationale for asking questions about the foreign employer when the point is I've left? I could understand if I was working for a British company whilst living abroad or something?

I think they are just trying to determine if you are still liable to the UK for taxes or if they you sign you off the tax rolls. They don't trust that you might misunderstand the tax laws and tax treaties and such. Too bad they don't have a choice "I'm outta here!".

Saying No does make sense because that lets them know you are not earning any money for which they might could collect taxes under certain circumstances.
