Hey Guys,

Im about to file my concurrent i-485 and i-130 and have one issue...

How many years tax returns does my spouse need to provide? I've read its anywhere between 1 year and 5years....

My wife earned $21000 in 2014 and has all the tax transcrips and W2 forms to prove that. As far as i'm aware this is slightly above the 125% poverty threshold however she hasn't earned over the threshold previous to 2014.

Will my application be successful if i submit only proof of 2014 income or will i be required to find a joint sponsor?

Thanks in advance.

Hi,

It looks like I wrote this post :)))

I did exactly the same amount of money for 2014, same situation as you but I filed my forms 2 weeks ago.

I did a consultation before filing the forms and they said that it was fine. I live in Michigan and I double checked the poverty line and they were right.

How much does she earn now?

Hey ami, that's good to know and gives me confidence that it could be ok.

She actually isn't working any longer but has an income from her family / trust off approximately 5k per month into her account so we put down 50k annual income. Problem being that income isn't taxable. The only taxable income she has is for 2014 tax returns showing 21000 taxable income.

I just don't want to file and the be sent a RFE later if not sufficient.

Wonder why it is not taxable?

Presumably she can substantiate the trust income as a regular amount.

The trust is tax exempt as inheritance tax has already been paid at the time the trust was set up.

Sounds like there is a need for decent Financial Planning.

Presumably the Trustees can provide a statement of income.
